The Council adopted a Decision on the position to be taken by the Community within the Association Council established by the Europe Agreement between the European Communities and their Member States, of the one part, and the Republic of Slovenia, of the other part, signed on 10 June 1996, with regard to the adoption of the rules for the implementation of Article 65(1)(i), (1)(ii) and (2) of the Europe Agreement and for the implementation of Article 7(1)(i), (1)(ii) and (2) of Protocol 2 on ECSC products to the Europe Agreement.

8. Whereas the Mixed Committee, established pursuant to Article 3 of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters' association with the implementation, application, and development of the Schengen acquis(1), has been informed about the preparation of this Decision in accordance with Article 5 of that Agreement,

La Commission a notamment reproché aux États membres défendeurs: a) d'avoir violé les principes de répartition des compétences externes entre la Communauté et les États membres (ce grief n'a toutefois pas été formulé à l'encontre du Royaume-Uni); b) d'avoir violé les dispositions du traité CE en matière de droit d'établissement (en insérant dans les accords une clause dite «de nationalité» qui permet en pratique à chacune des parties de refuser les droits prévus par lesdits accords à des transporteurs aériens désignés par l'autre État contractant, mais qui ne sont pas détenus ou contrôlés par des ressortissants dudit État), et c) dans l'hypothèse où les dispositions des accords contraires au droit communautaire étaient considérées comme antérieures à l'entrée en vigueur du traité, de n'avoir tout mis en oeuvre pour rendre ces dispositions pleinement compatibles avec la réglementation communautaire (ce grief n'a pas non plus été formulé à l'encontre du Royaume-Uni).
In particular, the Commission charged the different Member States (a) with having infringed the principles relating to the division of external powers between the Community and the Member States (a charge not made, however, against the United Kingdom), (b) with having infringed the provisions of the EC Treaty on the right of establishment by inserting in the agreements a "nationality clause", which in practice allows each party to refuse the rights provided for in the agreements themselves to air carriers designated by the other contracting State but not owned or controlled by nationals of that State and (c), in the event of the provisions that are contrary to Community law being held to predate the entry into force of the Treaty, with having failed to do everything possible to render those provisions fully compatible with the Community legislation (a charge not made against the United Kingdom).
