1. Les contreparties financières au sens de l’article 2, paragraphe 8, du règlement (UE) no 648/2012, et les contreparties non financières remplissant les conditions visées à l’article 10, paragraphe 1, point b), dudit règlement, qui concluent des transactions qui ne sont ni des transactions intragroupe au sens de l’article 3 de ce règlement ni des transactions couvertes par les dispositions transitoires de l’article 89 dudit règlement avec les autres contreparties financières ou avec les autres contreparties non financières remplissant les conditions visées à l’article 10, paragraphe 1, point b) du règlement (UE) no 648/2012 portant sur des dérivés appartenant à une catégorie d’instruments dérivés qui a été déclarée soumise à l’obligation de négocier selon la procédure prévue à l’article 32 et inscrite au registre visé à l’article 34, le font uniquement sur:
1. Financial counterparties as defined in Article 2(8) of Regulation (EU) No 648/2012 and non-financial counterparties that meet the conditions referred to in Article 10(1)(b) thereof shall conclude transactions which are neither intragroup transactions as defined in Article 3 of that Regulation nor transactions covered by the transitional provisions in Article 89 of that Regulation with other such financial counterparties or other such non-financial counterparties that meet the conditions referred to in Article 10(1)(b) of Regulation (EU) No 648/2012 in derivatives pertaining to a class of derivatives that has been declared subject to the trading obligation in accordance with the procedure set out in Article 32 and listed in the register referred to in Article 34 only on:

The purpose of the financial security is to ensure that the costs of fulfilling these obligations (such as monitoring or measures in case of leakages) are covered, should the operator not be in a position to do so.

f) "obligations financières couvertes", les obligations qui sont garanties par un contrat de garantie financière et qui donnent droit à un règlement en espèces et/ou à la livraison d'instruments financiers.
(f) "relevant financial obligations" means the obligations which are secured by a financial collateral arrangement and which give a right to cash settlement and/or delivery of financial instruments.

2. 2. Where a collateral taker exercises a right of use, he thereby incurs an obligation to transfer equivalent collateral to replace the original financial collateral at the latest on the due date for the performance of the relevant financial obligations covered by the security financial collateral arrangement.

(10) Pour les mêmes raisons, la constitution, la validité, la conclusion, l'opposabilité ou l'admissibilité à titre de preuve d'un contrat de garantie financière ou la constitution d'une garantie financière dans le cadre d'un contrat de garantie financière ne devraient pas être subordonnées à l'accomplissement d'un acte formel tel que l'établissement d'un document sous une forme spécifique ou d'une manière particulière, l'enregistrement auprès d'un organisme officiel ou public ou l'inscription dans un registre public, la publicité dans un journal ou une revue, dans un registre ou une publication officiels ou sous toute autre forme, la notification à un officier public ou la fourniture, sous une forme particulière, de preuves concernant la date d'établissement d'un document ou d'un instrument, le montant des obligations financières couvertes ou tout autre sujet.
(10) For the same reasons, the creation, validity, perfection, enforceability or admissibility in evidence of a financial collateral arrangement, or the provision of financial collateral under a financial collateral arrangement, should not be made dependent on the performance of any formal act such as the execution of any document in a specific form or in a particular manner, the making of any filing with an official or public body or registration in a public register, advertisement in a newspaper or journal, in an official register or publication or in any other matter, notification to a public officer or the provision of evidence in a particular form as to the date of execution of a document or instrument, the amount of the relevant financial obligations or any other matter.
