En ce qui concerne le contenu de l'épreuve d'aptitude, il ressort de la décision du 9 janvier 1997 de la Commission que les mesures nationales susceptibles de gêner ou de rendre moins attrayant l'exercice des libertés fondamentales garanties par le Traité doivent être appliquées de manière non discriminatoire, se justifier par des raisons impérieuses d'intérêt général, garantir la réalisation de l'objectif qu'elles poursuivent et ne pas aller au-delà de ce qui est nécessaire pour atteindre cet objectif.
