IN-CONTEXT TRANSLATIONS

1. À l'initiative de la Commission, le Fonds peut financer, dans la limite de 2% de ses ressources disponibles, des actions transnationales ou d'intérêt communautaire (ci-après, les «actions communautaires») en rapport avec l'objectif général visant à contribuer à l'amélioration des activités organisées par les services consulaires des États membres dans les pays tiers et la coopération entre États membres dans ce domaine, et avec l'objectif visant à encourager l'inclusion progressive des contrôles douaniers, vétérinaires et phytosanitaires dans la gestion intégrée des frontières, selon l'évolution que connaîtront éventuellement les politiques en cette matière.
1. At the Commission’s initiative, up to 2% of the Fund’s available resources may be used to finance transnational actions or actions of interest to the Community as a whole (‘Community actions’) concerning the general objective of contributing to enhancement of the activities organised by the consular services of the Member States in third countries and the co-operation between Member States thereof and the objective of promoting the progressive inclusion of the customs, veterinary, phyto-sanitary controls in integrated border management activities according to the policy evolution in this field.

Cependant, dans les zones objectifs 1, le taux de cofinancement peut s'élever à 80 % au maximum et dans des cas dûment justifiés, présentant un intérêt communautaire particulier dans le domaine des actions innovatrices, le cofinancement peut s'élever à 60 % au maximum dans les zones objectif 2.
However, a maximum rate of up to 80% may be applied to projects located in Objective 1 regions and, in justified cases of particular Community interest as regards innovative actions, a maximum rate of 60% may be applied in Objective 2 areas.

Dans le cas où la Commission déciderait que les mesures adoptées par les autorités espagnoles au regard du déploiement de la télévision numérique terrestre dans la zone II constituent des aides d'État, incompatibles avec le marché intérieur en application de l'article 106 du TFUE, l'Espagne soutient que ces mesures sont parfaitement compatibles avec le marché intérieur étant donné que leur finalité est de poursuivre un objectif d'intérêt communautaire (le passage à la radiodiffusion numérique), de sorte qu'elles relèveraient de l'exception visée à l'article 107, paragraphe 3, point c) du TFUE.
In the event of the Commission deciding that the measures taken by the Spanish authorities with regard the deployment of digital terrestrial television in Area II constitute state aid, and that they are not compatible with the internal market in application of article 106 TFEU, Spain claims that they would certainly be compatible with the internal market insofar as their purpose is to ensure that an objective which is of community interest is achieved (the conversion to digital broadcasting), so they would benefit from the exemption provided for in Article 107(3)(c) TFEU.

This Decision should provide for the possibility of co-financing activities of certain bodies pursuing aims of a general Community interest on Community-wide issues in the field of financial services and designing standards, endorsing standards or supervising standard-setting processes in the field of financial reporting and auditing.

Par conséquent, pour qu'une procédure d'autorisation préalable soit justifiée au regard du principe fondamental de la libre circulation des marchandises sur le marché intérieur, elle devrait répondre à un objectif d'intérêt public reconnu par le droit communautaire et être non discriminatoire et proportionnée, autrement dit, être de nature à permettre la réalisation de l'objectif poursuivi mais ne pas aller au-delà de ce qui est nécessaire pour atteindre ledit objectif.
Therefore, in order to be justified with regard to the fundamental principle of the free movement of goods within the internal market, a mandatory prior authorisation procedure should pursue a public-interest objective recognised by Community law, and should be non-discriminatory and proportionate; that is to say, it should be appropriate to ensure achievement of the aim pursued but not go beyond what is necessary in order to achieve that aim.

4. 4. The activities carried out by bodies which may receive Community funding (public procurement contract or grant) under the programme shall come under the heading of actions aimed at strengthening Community measures to protect financial interests and shall pursue objectives of general European interest in this field or an objective which is part of the European Union's policy in this area’.

Member States should be able to lay down proportionate obligations on undertakings under their jurisdiction, in the interest of legitimate public policy considerations, but such obligations should only be imposed where they are necessary to meet general interest objectives clearly defined by Member States in conformity with Community law and should be proportionate, transparent and subject to periodical review".

(12) considérant qu'il est, en conséquence, nécessaire de préserver le bon fonctionnement du marché intérieur et de prévenir les risques de refragmentation en prévoyant une procédure d'information, de consultation et de coopération administrative relative aux nouveaux projets de réglementation; qu'une telle procédure contribuera, notamment, à assurer une application efficace du traité, en particulier ses articles 52 et 59, ou, le cas échéant, à détecter le besoin d'assurer au niveau communautaire la protection d'un intérêt général; que, en outre, la meilleure application du traité permise par une telle procédure d'information aura pour conséquence de réduire le besoin de réglementations communautaires à ce qui est strictement nécessaire et proportionnel au regard du marché intérieur et de la protection d'objectifs d'intérêt général; que, enfin, cette procédure d'information permettra une meilleure exploitation par les entreprises des avantages du marché intérieur;
(12) Whereas it is therefore necessary to preserve the smooth functioning of the internal market and to avert the risks of refragmentation by providing for a procedure for the provision of information, the holding of consultations, and administrative cooperation in respect of new draft rules and regulations; whereas such a procedure will help, inter alia, to ensure that the Treaty, in particular Articles 52 and 59 thereof, is effectively applied and, where necessary, to detect any need to protect the general interest at Community level; whereas, moreover, the improved application of the Treaty made possible by such an information procedure will have the effect of reducing the need for Community rules to what is strictly necessary and proportional in the light of the internal market and the protection of general-interest objectives; whereas, lastly, such a procedure will enable businesses to exploit the advantages of the internal market more effectively;
