The Commission will continue to monitor closely Croatia's fulfilment of all the commitments undertaken in the accession negotiations, including those which must be achieved before the date of accession, and its continued preparations to assume the responsibilities of membership upon accession.

Reminds Romania that the credibility of commitments in the negotiations rests in particular on a thorough administrative reform; therefore calls on the Romanian Government to increase its efforts to build up the administrative capacity in all areas of law; asks the prime minister in particular for strong political leadership in this area in order to prepare Romania to be able to implement EU laws; this should result in particular in a clarification of the role of regional levels of administration and the reinforcement of inter-ministerial cooperation; calls on the Romanian Government to put particular emphasis on improving implementation and enforcement in the areas of competition, company law, agriculture, fisheries, transport and justice and home affairs;

(9) considérant que la réalisation d'un marché unique pour la Communauté pour le secteur du riz implique l'établissement d'un régime unique des échanges aux frontières extérieures de celle-ci; qu'un régime des échanges, s'ajoutant au système de l'intervention et comportant un régime de droits à l'importation et de restitutions à l'exportation, est de nature, en principe, à stabiliser le marché communautaire; que ce régime des échanges repose sur les engagements pris dans le cadre des négociations commerciales multilatérales du cycle d'Uruguay; que les types de riz aux différents stades d'usinage, et notamment le riz de type Indica et le riz de type japonica, sont ponctuellement identifiés par des codes NC; que la possibilité pour les opérateurs de connaître avant l'arrivée des expéditions concernées la charge à appliquer pourrait faciliter la mise en oeuvre des accords internationaux;
(9) Wheres the creation of a single Community market for rice involves the introduction of a single trading system at the external frontiers of the Community; whereas a trading system including import duties and export refunds, in addition to the intervention measures, should, in principle, stabilize the Community market; whereas the trading system is based on the undertakings given under the Uruguay Round of multilateral trade negotiations; whereas certain types of rice at the various stages of processing, in particular indica rice and japonica rice, are identified by means of CN codes; whereas the possibility of operators knowing, before the arrival of the consignments in question, the charge to be applied, could facilitate the implementation of international agreements;

considérant que l'appréciation, selon les critères généraux fixés, du caractère abusif des clauses notamment dans les activités professionnelles à caractère public fournissant des services collectifs prenant en compte une solidarité entre usagers, nécessite d'être complétée par un moyen d'évaluation globale des différents intérêts impliqués; que ceci constitue l'exigence de bonne foi; que, dans l'appréciation de la bonne foi, il faut prêter une attention particulière à la force des positions respectives de négociation des parties, à la question de savoir si le consommateur a été encouragé par quelque moyen à donner son accord à la clause et si les biens ou services ont été vendus ou fournis sur commande spéciale du consommateur; que l'exigence de bonne foi peut être satisfaite par le professionnel en traitant de façon loyale et équitable avec l'autre partie dont il doit prendre en compte les intérêts légitimes;
Whereas the assessment, according to the general criteria chosen, of the unfair character of terms, in particular in sale or supply activities of a public nature providing collective services which take account of solidarity among users, must be supplemented by a means of making an overall evaluation of the different interests involved; whereas this constitutes the requirement of good faith; whereas, in making an assessment of good faith, particular regard shall be had to the strength of the bargaining positions of the parties, whether the consumer had an inducement to agree to the term and whether the goods or services were sold or supplied to the special order of the consumer; whereas the requirement of good faith may be satisfied by the seller or supplier where he deals fairly and equitably with the other party whose legitimate interests he has to take into account;

Ces sessions avaient par objet notamment de : - faire le point sur l'état des négociations; - constater que les négociations portent désormais formellement sur l'adhésion des Etats candidats à l'Union européenne et se déroulent donc au titre de l'article O du Traité de Maastricht; - élargir le programme de travail aux chapitres nouveaux relevant du Traité sur l'Union européenne, à savoir l'UEM, la PESC, les affaires intérieures et judiciaires; - confirmer ensemble avec les Etats candidats les objectifs que le Conseil européen a définis pour la date d'adhésion, le 1er janvier 1995, la date d'aboutissement des négociations, le 1er mars 1994, ce qui implique en particulier qu'une percée significative à cet effet soit réalisée avant la fin de l'année.
The aim of the meetings was in particular to: - take stock of progress in the negotiations; - record that the negotiations were now formally for the accession of the applicant States to the European Union and would therefore be conducted under Article O of the Maastricht Treaty; - extend the work programme to the new chapters of the Treaty on European Union, namely EMU, CFSP, home affairs and justice; - confirm together with the applicant States the objectives which the European Council had defined for the accession date, 1 January 1995, the date for the completion of the negotiations, 1 March 1994, which in particular implied that a significant breakthrough should be made before the end of the year.
