L’article 4, troisième alinéa, du règlement (CE) no 555/2008 prévoit que, lors de la sélection des bénéficiaires, la préférence est accordée aux micro, petites et moyennes entreprises au sens de la recommandation 2003/361/CE de la Commission (4) et aux marques en nom collectif.

Les États membres peuvent exclure du champ d’application de la présente directive les créances privées lorsque le débiteur est un consommateur au sens de l’article 3, point a), de la directive 2008/48/CE du Parlement européen et du Conseil du 23 avril 2008 concernant les contrats de crédit aux consommateurs (17) ou une microentreprise ou une petite entreprise au sens de l’article 1er et de l’article 2, paragraphes 2 et 3, de l’annexe de la recommandation 2003/361/CE de la Commission du 6 mai 2003 concernant la définition des micro, petites et moyennes entreprises (18), sauf si le preneur de la garantie ou le constituant de la garantie pour ces créances privées est une des institutions visées à l’article 1er, paragraphe 2, point b), de la présente directive.
Member States may exclude from the scope of this Directive credit claims where the debtor is a consumer as defined in Article 3(a) of Directive 2008/48/EC of the European Parliament and of the Council of 23 April 2008 on credit agreements for consumers (17) or a micro or small enterprise as defined in Article 1 and Article 2(2) and (3) of the Annex to Commission Recommendation 2003/361/EC of 6 May 2003 concerning the definition of micro, small and medium-sized enterprises (18), save where the collateral taker or the collateral provider of such credit claims is one of the institutions referred under Article 1(2)(b) of this Directive.
