According to Council Regulation (EC) No 216/2001 the EU will remove the tariff quota structure and introduce a "tariff only" regime for banana imports no later than 1 January 2006.

In the matter of SOR/2001-34 — Regulations Amending the Export Permits Regulations; and SOR/2003-216 — Regulations Amending the Export Permits Regulations (Miscellaneous Program), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Foreign Affairs and International Trade Canada with respect to certain comments made by the committee.

In 2001 the Community amended the COM for bananas by Council Regulation (EC) No 216/2001 of 29 January 2001 amending Regulation No 404/93 (OJ 2001 L 31, p. 2). The United States suspended application of the increased customs duty with effect from 30 June 2001.
