TRADUCTIONS EN CONTEXTE

(1) Dans sa résolution du 25 septembre 2008 sur un plan européen global de lutte contre la contrefaçon et le piratage , le Conseil de l'Union européenne a demandé le réexamen du règlement (CE) n° 1383/2003 du Conseil du 22 juillet 2003 concernant l'intervention des autorités douanières à l'égard de marchandises soupçonnées de porter atteinte à certains droits de propriété intellectuelle ainsi que les mesures à prendre à l'égard de marchandises portant atteinte à certains droits de propriété intellectuelle .
(1) The Council of the European Union requested, in its Resolution of 25 September 2008 on a comprehensive European anti-counterfeiting and anti-piracy plan , that Council Regulation (EC) No 1383/2003 of 22 July 2003 concerning customs action against goods suspected of infringing certain intellectual property rights and the measures to be taken against goods found to have infringed such rights be reviewed.

(19) La réglementation du marquage de l'origine constitue également un moyen de défense efficace contre la contrefaçon et la concurrence déloyale, en renforçant ainsi l'efficacité du règlement (CE) n° 1383/2003 du Conseil du 22 juillet 2003 concernant l'intervention des autorités douanières à l'égard de marchandises soupçonnées de porter atteinte à certains droits de propriété intellectuelle ainsi que les mesures à prendre à l'égard de marchandises portant atteinte à certains droits de propriété intellectuelle et en dotant la production de l'Union d'un autre instrument important de protection et de valorisation.
(19) Rules on origin marking also provide effective protection against counterfeiting and unfair competition, thereby enhancing the effectiveness of Council Regulation (EC) No 1383/2003 of 22 July 2003 concerning customs action against goods suspected of infringing certain intellectual property rights and the measures to be taken against goods found to have infringed such rights providing a further important instrument to protect and enhance Union production.

8 bis) La réglementation de la marque d'origine constitue également un bon moyen de défense contre la contrefaçon et la concurrence déloyale, en complétant l'effet du règlement (CE) n° 1383/2003 du Conseil du 22 juillet 2003 concernant l'intervention des autorités douanières à l'égard de marchandises soupçonnées de porter atteinte à certains droits de propriété intellectuelle ainsi que les mesures à prendre à l'égard de marchandises portant atteinte à certains droits de propriété intellectuelle et en dotant la production européenne d'un autre instrument adéquat de protection et de valorisation.

Le règlement (CE) no 1383/2003 a introduit des règles communes dans le but d'interdire l'introduction, la mise en libre pratique, la sortie, l'exportation, la réexportation, le placement sous un régime suspensif, en zone franche, ou en entrepôt franc, de marchandises de contrefaçon et de marchandises pirates, et de faire face efficacement à la commercialisation illégale de telles marchandises sans pour autant entraver la liberté du commerce légitime.
Regulation (EC) No 1383/2003 introduced common rules with a view to prohibiting the entry, release for free circulation, exit, export, re-export or entry for a suspensive procedure of counterfeit and pirated goods, and to dealing effectively with the illegal marketing of such goods without impeding the freedom of legitimate trade.

Le règlement (CE) no 1383/2003 ayant remplacé le règlement (CE) no 3295/94 du Conseil du 22 décembre 1994 fixant certaines mesures concernant l’introduction dans la Communauté et l’exportation et la réexportation hors de la Communauté de marchandises portant atteinte à certains droits de propriété intellectuelle (2), il convient de remplacer le règlement (CE) no 1367/95 de la Commission (3) qui a arrêté les dispositions d’application du règlement (CE) no 3295/94.
Since Regulation (EC) No 1383/2003 replaced Council Regulation (EC) No 3295/94 of 22 December 1994 laying down measures concerning the entry into the Community and the export and re-export from the Community of goods infringing certain intellectual property rights (2), it is also necessary to replace Commission Regulation (EC) No 1367/95 (3), which laid down provisions for the implementation of Regulation (EC) No 3295/94.
