Cette nouvelle opération s'appuie sur les progrès effectués en termes de stabilisation économique et de réformes structurelles dans le cadre des trois précédentes opérations d'AMF.

Follows with interest the implementation of the Commission's new budget support approach; notes that in 2013 a total of EUR 660 million was allocated to new budget support operations in Africa, used in part to implement the 'MDG initiative' to support those countries that were lagging behind in important sectors such as health, water, sanitation, food security and nutrition; notes that the new budget support approach seems to be bearing fruit, with the adoption of the first State Building Contract with Haiti in December 2013 and the suspension of several disbursements where conditions were considered as having not been met, such as Zambia and Mozambique (macroeconomic issues), as well as Malawi and Uganda (corruption); welcomes the fact that the number of budget support-related errors decreased by 82 % from 2011 to 2013;

En ce qui concerne le FSE, la Commission a adopté le 12 janvier 2001 une "Communication sur la mise en oeuvre des actions innovatrices au titre de l'article 6 du règlement relatif au Fonds social européen pour la période de programmation 2000-2006" [6]. Cette communication précise comment la Commission entend exploiter les possibilités offertes par les actions innovatrices au titre de l'article 6 du règlement FSE pour promouvoir de nouvelles approches et recenser des exemples de bonnes pratiques à l'appui des opérations traditionnelles relevant du FSE.
As for the ESF, on 12 January the Commission adopted a "Communication on the implementation of innovative measures under Article 6 of the European Social Fund Regulation for the programming period 2000-2006" [6] setting out how it intends to use the possibilities offered by Article 6 of the ESF Regulation to promote new approaches and identify examples of good practice in support of mainstream ESF operations.

Les États membres sont invités à: mettre en œuvre, à l’horizon 2012, la recommandation formulée dans le plan d’action SBA proposant de réduire le délai de création d’une nouvelle entreprise à trois jours ouvrables et le coût à 100 euros; réduire à un mois, d’ici fin 2013, le délai nécessaire à l’obtention des licences et permis (y compris les permis environnementaux) pour reprendre et exercer l’activité spécifique d’une entreprise; mettre en œuvre, d’ici 2013, la recommandation formulée dans le plan d’action SBA en vue de rendre possible une seconde chance pour les entrepreneurs en limitant à un maximum de trois ans le délai de réhabilitation et le règlement des dettes pour un entrepreneur de bonne foi ayant fait faillite; développer, pour les entreprises transférables, des bases de données et des marchés conviviaux bénéficiant d’un large soutien, ainsi que fournir une formation et un appui pour accroître le nombre de transferts d’entreprises réussis, notamment par des campagnes de communication visant à sensibiliser les parties intéressées à la nécessité de préparer à l’avance une telle opération.
The Member States are invited to: implement the recommendation set out in the SBA Action Plan to reduce the start-up time for new enterprises to 3 working days and the cost to €100 by 2012; reduce the time needed to get licences and permits (including environmental permits) to take up and perform the specific activity of an enterprise to one month by the end of 2013; implement the recommendation set out in the SBA Action Plan to promote second chances for entrepreneurs by limiting the discharge time and debt settlement for an honest entrepreneur after bankruptcy to a maximum of three years by 2013; develop user-friendly and widely supported marketplaces and databases for transferrable businesses and provide training and support to increase the number of successful business transfers, including communication campaigns to raise awareness of the need for early preparation of business transfers.

In particular, considerable gaps still exist regarding material contributions to the Rapid Reaction Equipment pool, deployments to ongoing joint operations and to the three new pools of forced-return monitors, forced-return escorts and return specialists.These gaps should be filled by Member States by the end of March 2017 to ensure that the Agency can provide the necessary support to Member States at the external borders.

De façon générale, la garantie de l’Union n’est pas accordée à l’appui d’opérations de refinancement (telles que le remplacement de contrats de prêt existants ou d’autres formes d’aide financière pour des projets qui ont déjà été partiellement ou entièrement concrétisés), sauf dans des circonstances exceptionnelles et bien justifiées, dans lesquelles il est démontré qu’une telle opération permettra un nouvel investissement d’un montant au moins équivalent au montant de la transaction, qui répondrait aux critères d’éligibilité et aux objectifs généraux fixés respectivement à l’article 6 et à l’article 9, paragraphe 2.
As a rule, the EU guarantee shall not be granted for supporting refinancing operations (such as replacing existing loan agreements or other forms of financial support for projects which have already partially or fully materialised), except in exceptional and well-justified circumstances where it is demonstrated that such a transaction will enable a new investment of an amount at least equivalent to the amount of the transaction and that would fulfil the eligibility criteria and general objectives laid down in Article 6 and Article 9(2) respectively.
