The new Implementing Law provides that judgments of the Tribunal and decisions of the Tribunal adopted in breach of the Constitutional Tribunal Act of 25 June 2015 or the Constitutional Tribunal Act of 22 July 2016 and issued prior to the date of entry into force of the new Law on organisation and proceedings shall be published in the relevant official gazettes after their publication has been ordered by the acting President of the Tribunal, unless they concern regulatory instruments that have ceased to apply.

Is concerned at some of the recent laws in some Member States that extend surveillance capabilities of intelligence bodies, including, in France, the new intelligence law adopted by the National Assembly on 24 June 2015, several provisions of which, according to the Commission, raise important legal questions, in the UK, the adoption of the Data Retention and Investigatory Powers Act 2014 and the subsequent court decision that certain articles were unlawful and to be disapplied, and, in the Netherlands, the proposals for new legislation to update the Intelligence and Security Act of 2002; reiterates its call on all Member States to ensure that their current and future legislative frameworks and oversight mechanisms governing the activities of intelligence agencies are in line with the standards of the European Convention on Human Rights and all relevant Union legislation; asks the Commission to launch without delay an assessment of all provisions of the French intelligence law and to determine its compliance with European primary and secondary law;

F. considérant que la loi égyptienne n° 84/2002, qui régit le fonctionnement et les activités des ONG, adoptée sous le régime de l'ancien président Moubarak, continue à être utilisée contre les organisations de la société civile en Égypte; que les attaques contre les bureaux des ONG et les jugements contre les employés de celles-ci font clairement ressortir l'urgence d'adopter une nouvelle loi et de nouvelles règles protégeant et encourageant les activités de la société civile dans le pays; que le président Morsi a envoyé le 29 mai 2013 au conseil de la Choura un nouveau projet de loi relatif aux ONG qui a suscité une vague de critiques; que cette loi, si elle était adoptée sous sa forme actuelle, renforcerait encore et institutionnaliserait le contrôle étatique sur la société civile en donnant des pouvoirs excessifs au gouvernement; que toute nouvelle loi sur les ONG devrait être élaborée en coopérant pleinement avec les acteurs de la société civile égyptienne, dans le plein respect des engagements et obligations du pays sur le plan international et en conformité avec les normes internationales;
F. whereas Egyptian Law 84/2002 regulating the functioning and activities of NGOs, adopted under the regime of former President Mubarak, continues to be used against civil society organisations in Egypt; whereas the raids on NGO offices, and the court sentences against NGO workers, are clear indications of an urgent need to adopt a new law and new regulations protecting and encouraging civil society activities in the country; whereas, on 29 May 2013, President Morsi sent to the Shoura Council a new draft law on NGOs that has provoked widespread criticism; whereas this law, if adopted in its current shape, would further strengthen and institutionalise state control over civil society by giving excessive powers to the government; whereas any new law on NGOs should be drafted in full cooperation with Egyptian civil society actors, must fully comply with the country’s international commitments and obligations, and should follow international standards;

15. Welcomes further good progress in adopting anti-corruption legislation, in particular the new public procurement law, the law on the financing of political parties and the amendments to the law on conflict of interest; notes, however, that the new public procurement law may be more restrictive than previous legislation and might therefore discourage reporting on corruption; is concerned about the strong role of representatives of political parties in the Commission for the Prevention of Conflict of Interest, which is responsible for implementing the new amendments to the law on conflict of interest; is of the view that the current draft law on the free access to information may restrict access to information and, by doing so, may reduce the ability of civil society organisations and the media to reveal corruption cases; notes that corruption is still prevalent in many areas, continues to be an issue of particular concern and can also cause significant costs to public finances;
