L'élargissement du champ d'application du règlement au secteur agricole aura pour effet de compliquer l'administration du FEM (la DG AGRI y sera associée, au même titre que la DG EMPL, de nouveaux actes délégués devront être adoptés pour chaque nouvel accord commercial international, etc.), d'affecter à l'adaptation des agriculteurs des moyens destinés aux entreprises (ce qui constitue l'objectif premier de la PAC) et de modifier l'objectif premier du FEM, qui est de réagir aux conséquences imprévisibles de la mondialisation et des crises, afin de faire face à des situations plus que prévisibles (les accords commerciaux internationaux en matière d'agriculture ont des conséquences prévisibles qui ne sont pas directement liées aux effets de la mondialisation).

Also to be excluded from the scope of this Regulation are agreements relating to marketing know-how communicated in the context of franchising arrangements and certain licensing agreements entered into in connection with arrangements such as joint ventures or patent pools and other arrangements in which a licence is granted in exchange for other licences not related to improvements to or new applications of the licensed technology. Such agreements pose different problems which cannot at present be dealt with in a single regulation (Article 5).
