Je rappelle que, dès le 1 décembre prochain, il y aura de nouvelles institutions dans l’Union: un président du Conseil européen, un haut-représentant avec des pouvoirs complètement nouveaux, un service d’action extérieure de l’Union, et nous aurons donc à prendre des décisions budgétaires extrêmement rapides si nous voulons que le nouveau Traité puisse s’appliquer à la date prévue.
I would point out that, from 1 December, there will be some new institutions within the Union: a President of the European Council, a High Representative with completely new powers, and a European External Action Service. We will therefore have to take some extremely quick budgetary decisions if we want the new treaty to come into force on the date set.

After the five years transitional period provided by the Amsterdam Treaty for Title IV of the TEC and the entry into force of the new Treaty on the Functioning of the European Union, it is legally no longer possible to establish a decision making procedure with a right of initiative for a Member State; it is even unacceptable, from an institutional point of view, to accept that a Member State's suggestion or intention (to abolish the visa requirement for diplomatic passport holders of a country under prior consultation) would bind the Commission's right of initiative; the Commission cannot be obliged to present a proposal.

Hopes that the Convention will start work immediately after the Laeken European Council and complete its work in time to allow the Intergovernmental Conference to wind up its proceedings by the end of 2003 under the Italian Presidency so as to enable the new treaty to be adopted in December of that year, thereby ensuring that, in 2004, the European elections can act as a democratic fillip to European integration and that, together with the Commission, the European Parliament will be able to play its part in that process under the best possible conditions; considers that the period between presentation of the results of the Convention and the opening summit should be as short as possible, and in any case not longer than three months;

Le Conseil de l'EEE : - s'est félicité de la décision positive du Conseil de l'UE sur la proposition visant à introduire le cumul diagonal entre les pays de l'EEE, traités comme un seul territoire aux fins des règles d'origine, la Suisse et les PECO associés, et a exprimé l'espoir que le cumul européen diagonal s'applique dans un proche avenir ; - a déploré que les négociations bilatérales sur les mesures autonomes relatives aux produits agricoles transformés, qui constituent une base essentielle pour le parachèvement du Protocole 3 de l'accord sur l'EEE, n'aient pas été menées à terme et a invité instamment toutes les parties à tout mettre en oeuvre pour les achever afin que le Comité mixte de l'EEE puisse faire en sorte que le Protocole 3 de l'accord EEE soit rapidement terminé ; - a constaté que l'UE avait engagé les procédures visant à l'intégration du règlement sur le cabotage maritime dans l'accord sur l'EEE, notamment la consultation du Parlement européen, et a exprimé l'espoir qu'une solution satisfaisante pour les deux parties puisse être bientôt trouvée ; - a pris acte de la poursuite des négociations sur des accords parallèles avec certains pays tiers en ce qui concerne la reconnaissance mutuelle de l'évaluation de la conformité (ARM) en application du Protocole 12 de l'accord sur l'EEE ; - a relevé les progrès satisfaisants des vastes travaux techniques visant à préparer l'intégration de la législation sur les contrôles vétérinaires aux frontières à l'accord sur l'EEE, ouvrant ainsi la voie à l'extension de cette partie du marché intérieur à l'EEE, à temps pour la mise en oeuvre par l'UE du nouveau système de contrôles aux frontières.
The EEA Council: - welcomed the positive decision of the EU Council on the proposal regarding the introduction of diagonal cumulation between the EEA countries, treated as one block for the purpose of rules of origin, and Switzerland and the associated CEEC, and expressed the hope that diagonal European cumulation would be in operation in the near future; - regretted that bilateral negotiations on autonomous measures related to processed agricultural products, which are an essential basis for the completion of Protocol 3 to the EEA Agreement, had not been concluded and urged all parties to do their utmost to conclude them in order for the EEA Joint Committee to work towards completion of Protocol 3 to the EEA Agreement; - noted that the procedures in the EU for the integration of the Regulation on maritime cabotage into the EEA, notably the consultation of the European Parliament, have been initiated and expressed the hope that a mutually satisfactory solution can be found soon; - noted the continuation of negotiations on parallel agreements with certain third countries concerning mutual recognition of conformity assessment (MRAs) in accordance with Protocol 12 to the EEA Agreement; - noted the good progress of extensive technical work in preparation for the integration of legislation on veterinary border controls into the EEA Agreement; opening the way for the extension of that part of the internal market into the EEA in time for the implementation of the new system of border checks by the EU. 8. The EEA Council reviewed the functioning of institutional aspects of the EEA Agreement.

La décision finale sur le texte du traité sur l'Union politique et l'Union économique et monétaire sera prise au Conseil européen de Maastricht afin que les résultats des deux conférences puissent être soumis à ratification simultanément dans le courant de l'année 1992 et que le nouveau traité puisse entrer en vigueur le 1er janvier 1993.
The final decision on the text of the Treaty on Political Union and on Economic and Monetary Union will be taken by the Maastricht European Council so that the results of the two Conferences can be submitted for ratification simultaneously during 1992 and the new Treaty can enter into force on 1 January 1993.

Cette décision de la Commission est prise en référence à la jurisprudence de la Cour (arrêt Boussac, du 14 Février 1990), qui pévoit que lorsqu'une infraction à l'article 93 § 3 du Traité a été commise par un Etat membre, la Commission puisse suspendre immédiatement tout nouveau versement et demander à l'Etat membre de lui fournir dans un délai (un mois) prévu dans sa décision tout élément nécessaire pour apprécier la compatibilité de l'aide avec le Marché commun.
This Commission decision has been taken in the light of the Court's case-law (Boussac judgment of 14 February 1990) which stipulates that, where a Member State has infringed Article 93(3) of the Treaty, the Commission may immediately suspend any further payment and request that Member State to provide it, within a period (one month) laid down in its decision, with any information necessary for enable it to assess whether or not the aid is compatible with the common market.
