IN-CONTEXT TRANSLATIONS

Pour assurer la bonne application des règles énoncées dans le présent règlement et de rendre ces notifications rapides, efficaces, précises, financièrement rationnelles et compatibles avec la protection des données à caractère personnel, il convient de déléguer à la Commission le pouvoir d'adopter certains actes en ce qui concerne l'établissement des mesures nécessaires relatives aux notifications à effectuer par les États membres à la Commission ou aux fins de la vérification, du contrôle, du suivi, de l'évaluation et de l'audit des paiements directs et du respect des obligations figurant dans les accords internationaux, y compris les exigences en matière de notification dans le cadre desdits accords et en ce qui concerne d'autres règles établissant la nature et le type d'informations à notifier, les catégories de données à traiter et le délai de conservation maximal, les droits d'accès aux informations ou aux systèmes d'information, ainsi que les conditions de publication des informations.
In order to ensure the correct application of the rules set out in this Regulation and to make such notifications fast, efficient, accurate, cost-effective and compatible with the protection of personal data, the power to adopt certain acts should be delegated to the Commission in respect of establishing the necessary measures regarding notifications to be made by Member States to the Commission or for the purpose of checking, controlling, monitoring, evaluating and auditing direct payments and for complying with requirements laid down in international agreements, including notification requirements under those agreements and in respect of further rules on the nature and type of the information to be notified, the categories of data to be processed and maximum period of retention, the access rights to the information or information systems and the conditions of publication of the information.

In exceptional circumstances, the provider should be permitted to delay the notification to the subscriber or individual, where the notification to the subscriber or individual may put at risk the proper investigation of the personal data breach.

5. Dans certains cas exceptionnels, s’il y a un risque que la notification à l’abonné ou au particulier nuise à l’efficacité de l’enquête sur la violation de données à caractère personnel, le fournisseur est autorisé, après avoir obtenu l’accord de l’autorité nationale compétente, à retarder la notification jusqu’au moment où ladite autorité juge possible de notifier la violation conformément au présent article.
5. In exceptional circumstances, where the notification to the subscriber or individual may put at risk the proper investigation of the personal data breach, the provider shall be permitted, after having obtained the agreement of the competent national authority, to delay the notification to the subscriber or individual until such time as the competent national authority deems it possible to notify the personal data breach in accordance with this Article.

Lithuania submitted the necessary information which in particular confirms that its bovine database is compatible with Article 5 of the Regulation: (i) the delays in notification of events are highlighted in the database and thus the deadlines for notifications of animal movements set in the Regulation are respected; (ii) that passports of animals moved outside of Lithuania are subsequently surrendered to the competent authority on arrival; (iii) there is an interface between the national bovine database and the national Agriculture Payment Scheme database as well as with the national Veterinary Information Management System to facilitate reconciliation controls and the exchange of useful data; and (iv) guidelines are reinforced so that ear tags are issued and distributed in a correct manner and this information is available to the database.
