Lastly, it is not possible for the applicant to rely on the judgment of 14 October 2008 in Meierhofer v Commission (Case F-74/07, set aside on appeal – but not as regards the finding that the statement of reasons for the decision was inadequate – by judgment of 12 May 2010 in Case T-560/08 P Commission v Meierhofer), in which the General Court annulled, on the ground that its statement of reasons was inadequate, the selection board’s decision not to include the applicant on the reserve list, since the Commission had refused to produce, in addition to the individual eliminatory mark received by the applicant in the oral test, further details such as the intermediate marks used to calculate that mark and, where appropriate, the evaluation sheets.

En cinquième lieu, le Tribunal de la fonction publique a tiré les conséquences de la présence de ces circonstances particulières et jugé que, si la communication au requérant de la note individuelle éliminatoire qu’il a reçue à l’épreuve orale, à savoir 24,5/50, constituait plus qu’un simple début de motivation pour lequel, selon la jurisprudence (arrêt du Tribunal du 6 novembre 1997, Berlingieri Vinzek/Commission, T‑71/96, RecFP p. I‑A‑339 et II‑921, point 79), des précisions complémentaires pouvaient être apportées en cours d’instance, en revanche, cette seule note n’était pas suffisante, dans les circonstances de l’espèce, pour satisfaire pleinement à l’obligation de motivation.
Fifthly, the Civil Service Tribunal held, in consequence of the existence of those special circumstances, that although the communication to the applicant of the individual eliminatory mark, of 24.5 out of 50, which he received in the oral test constitutes more than merely the initial elements of a statement of reasons which, according to the case-law (Case T‑71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I‑A‑339 and II‑921, paragraph 79), was susceptible of being supplemented by further information provided during the proceedings, that mark alone not being sufficient, in the particular circumstances, to satisfy fully the obligation to state reasons.

En troisième lieu, le Tribunal de la fonction publique a observé que, quand bien même l’issue de la conciliation entre l’obligation de motivation et le respect du principe du secret des travaux du jury, en particulier sur le point de savoir si la communication d’une seule note individuelle éliminatoire au candidat éliminé lors de la phase orale satisfait à ladite obligation, penche le plus souvent en faveur du principe du secret des travaux du jury, il peut en être autrement en présence de circonstances particulières, et ce d’autant plus que la jurisprudence récente concernant le règlement (CE) n° 1049/2001 du Parlement européen et du Conseil, du 30 mai 2001, relatif à l’accès du public aux documents du Parlement européen, du Conseil et de la Commission (JO L 145, p. 43), montrerait une évolution en faveur de la transparence (voir, en ce sens, arrêts de la Cour du 18 décembre 2007, Suède/Commission, C‑64/05 P, Rec. p. I‑11389, et du 1 juillet 2008, Suède et Turco/Conseil, C‑39/05 P et C‑52/05 P, Rec. p. I-4723) (point 40 de l’arrêt attaqué).
Thirdly, the Civil Service Tribunal observes that even though the outcome of reconciling the obligation to state reasons and observance of the principle of the secrecy of the selection board’s proceedings, in particular as to whether the communication of a single eliminatory individual mark to the candidate eliminated in the oral phase satisfies that obligation, is more often than not in favour of the principle of the secrecy of the selection board’s proceedings, the position may be otherwise when special circumstances exist, all the more so as the recent case-law concerning Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (OJ 2001 L 145, p. 43) shows a development of Community case-law in favour of openness (see, to that effect, Case C‑64/05 P Sweden v Commission [2007] ECR I‑11389, and Joined Cases C‑39/05 P and C‑52/05 P Sweden and Turco v Council [2008] ECR I‑4723) (paragraph 40 of the judgment under appeal).

À ce propos, le Tribunal de la fonction publique a mis en avant le fait que, si les correcteurs des épreuves écrites peuvent ne pas être connus des intéressés et sont, ainsi, à l’abri des ingérences et pressions auxquelles se réfère l’arrêt Parlement/Innamorati, point 16 supra, contrairement aux membres du jury siégeant lors de la phase orale, cette circonstance ne justifie pas objectivement l’existence de différences importantes entre les exigences de motivation en cas d’échec lors de la phase écrite, telles que ces exigences ressortent de la jurisprudence rappelée au point 39 de l’arrêt attaqué, et celles défendues par la Commission en cas d’échec à l’épreuve orale, qui, notamment en l’espèce, consisteraient à ne donner au requérant que sa note individuelle éliminatoire.
In that regard, the Civil Service Tribunal took the view that while the examiners marking the written tests, in contrast to the members of the selection board sitting in the oral phase, may admittedly not be known to the persons concerned, and are thereby protected from interference and pressures to which the judgment in Parliament v Innamorati, paragraph 16 above, refers, that circumstance does not objectively justify the existence of significant differences between the requirements concerning the statement of reasons in the case of failure in the written phase, as those requirements are formulated in the case-law cited in paragraph 39 of the judgment under appeal, and those advocated by the Commission in the case of failure in the oral test, which, in particular in the instant case, would consist in giving the applicant only his eliminatory individual mark.
