At present the following Regulations apply: Commission Regulation (EEC) 1696/87 of 10 June 1987 laying down certain detailed rules for the implementation of Council Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution , Commission Regulation (EC) No 804/94 of 11 April 1994 laying down certain detailed rules for the application of Council Regulation (EEC) No 2158/92 as regards forest-fire information systems , Commission Regulation (EC) No 1091/94 of 29 April 1994 laying down certain detailed rules for the implementation of Council Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution , Commission Regulation (EC) No 1727/1999 of 28 July 1999 laying down certain detailed rules for the application of Council Regulation (EEC) No 2158/92 on protection of the Community's forests against fire , Commission Regulation (EC) No 2278/1999 of 21 October 1999 laying down certain detailed rules for the application of Council Regulation (EEC) No 3528/86 on the protection of the Community's forests against atmospheric pollution .

Detailed rules for the implementation of those provisions should therefore be adopted and the existing legislation on the subject repealed, namely Commission Regulations (EEC) No 3201/90 of 16 October 1990 laying down detailed rules for the description and presentation of wines and grape musts(3), as last amended by Regulation (EC) No 885/2001(4), (EEC) No 3901/91 of 18 December 1991 laying down certain detailed rules on the description and presentation of special wines(5), (EC) No 554/95 of 13 March 1995 laying down detailed rules for the description and presentation of sparkling and aerated sparkling wines(6), as amended by Regulation (EC) No 1915/96(7), and (EC) No 881/98 of 24 April 1998 laying down detailed rules for the protection of the additional traditional terms used to designate certain types of quality wine produced in specified regions (quality wine psr)(8), as last amended by Regulation (EC) No 1608/2000(9).

Some hon. members: On division (Motion No. 7 negatived) (1230 ) Mr. Len Taylor (The Battlefords-Meadow Lake, NDP) moved: Motion No. 3 That Bill C-57, in Clause 8, be amended by replacing line 1, on page 4, with the following: ``8 (1) Subject to this section, the Agreement is hereby approved (2) In subsections (2) to (6), ``law of Canada'' includes laws duly enacted by any province or territory in Canada (3) No provision of the Agreement shall apply where its application or enforcement would result in contravention of any law of Canada (4) Nothing in the Agreement or in this Act shall be construed (a) to amend or modify any law of Canada, including any law relating to (i) protection of human or animal life, (ii) protection of the environment, or (iii) worker safety; or (b) to limit any authority conferred under a law of Canada, unless specifically provided for in this Act (5) As may be required, the Minister shall consult with the governments of the provinces and territories for the purpose of achieving conformity with the provisions of the Agreement (6) No law of Canada may be declared invalid on the ground that the law or its application or enforcement in a particular circumstance is inconsistent with any provision of the Agreement'.

Les principaux amendements proposés ont pour but : - de clarifier l'application de la directive aux transferts internationaux ou transferts de groupes d'entreprises; - de rendre plus souples les transferts effectués dans le cadre d'une procédure d'insolvabilité; - de prévoir une responsabilité conjointe limitée du cédant et du cessionnaire; - de préciser et d'étendre le champ d'application et les définitions de la directive existante (application de la directive aux travailleurs à temps partiel, aux travailleurs temporaires et aux travailleurs sous contrat à durée déterminée; application de la directive aux navires de mer; application de la directive à toutes les entreprises publiques ou privées exerçant des activités de nature économique ou commerciale, dans un but lucratif ou non); - d'accroître la protection des représentants des travailleurs; - de clarifier l'application de la directive lorsqu'une activité d'une entreprise seulement est transférée.
The main amendments proposed are designed to achieve the following: - clarify the application of the Directive to international transfers or transfers of groups of undertakings; - provide for greater flexibility in the event of transfers in the context of insolvency proceedings; - provide for limited joint liability on the part of the transferor and the transferee; - clarify and extend the scope and definitions in the existing Directive (application of the Directive to part-time workers, temporary workers and workers on fixed-duration contracts; application of the Directive to sea-going vessels; application of the Directive to all public or private undertakings carrying on activities of an economic or commercial nature, whether or not they are intended to operate for gain); - increase protection for workers' representatives; - clarify the application of the Directive where only an activity of an undertaking is transferred.
