Faute de plus amples informations, la Commission n'a pas pu apprécier cette mesure et elle n'a donc pu exclure que cet apport de capital de NordLB constituait également une aide d'État au sens de l'article 87, paragraphe 1, du traité CE.
The Commission could not evaluate this measure at the time because it lacked sufficient information and could not therefore conclude that the capital contributed by NordLB was also state aid within the meaning of Article 87(1) of the EC Treaty.
