S’agissant de dispositions dérogatoires visant à permettre la nomination de fonctionnaires du groupe de fonctions des assistants (AST) aux emplois du groupe de fonctions des administrateurs (AD) dans les conditions particulières qu’elles établissent, les dispositions de l’article 45 bis du statut relatives à la procédure de certification doivent être interprétées et appliquées de façon stricte.
The provisions of Article 45a of the Staff Regulations concerning the certification procedure, being derogating provisions designed to allow officials in the assistants function group (AST) to be appointed to posts in the administrators function group (AD) under the special conditions laid down therein, must be interpreted and applied restrictively.

2. 2. The Management Board shall adopt, in accordance with Article 110 of the Staff Regulations and Article 142 of the Conditions of Employment, a decision based on Article 2(1) of the Staff Regulations and on Article 6 of the Conditions of Employment, delegating the relevant appointing authority powers to the Executive Director and defining the conditions under which that delegation of appointing authority powers can be suspended.
