Without prejudice to Section I of this Chapter, on 1 January of each year, the Commission, on its own initiative and in accordance with the advisory procedure referred to in Article 39(2), shall adopt an implementing act in order to remove the tariff preferences referred to in Articles 7 and 12 with respect to the products from GSP sections S-11a and S-11b of Annex V or to products falling under Combined Nomenclature codes 2207 10 00, 2207 20 00, 2909 19 10, 3814 00 90, 3820 00 00, and 3824 90 97 where imports of such products, listed respectively in Annexes V or IX, whichever is applicable, originate in a beneficiary country and their total:

(49) In order to ensure uniform conditions for the implementation of this Regulation as regards exports and certain general provisions, implementing powers should also be conferred on the Commission in respect of measures on the treatment of refund certificates by the Member States and the exchange of information and the specific administrative assistance between the Member States as regards the refund certificates, measures on the fixing of the global amount allocated to small exporters and the individual threshold of exemption from the presentation of refund certificates, measures on the issuing of replacement refund certificates and duplicate refund certificates, measures limiting the amounts for which refund certificates may be issued, rejecting amounts applied for in respect of those certificates and suspending the lodging of applications for refund certificates where amounts that exceed available amounts fixed on the basis of the commitments resulting from international agreements, are applied for, necessary procedural rules and technical criteria for the application of other measures with regard of exports, measures on fixing the applicable duty in case of direct offsetting in preferential trade and the related amounts payable on exports to the country or region concerned, measures ensuring that processed agricultural products declared for export under a preferential trade agreement are not in fact exported under a non- preferential agreement or vice versa , measures concerning the methods of qualitative and quantitative analysis of processed agricultural products and non-Annex I goods, the technical provisions necessary for their identification and the procedures for the purpose of their classification in the Combined Nomenclature.

La Commission est habilitée à adopter des actes délégués conformément à l’article 16 bis en vue d’adapter la définition des limites quantitatives fixées à l’annexe V et des catégories de produits auxquelles elles s’appliquent, lorsque cela se révèle nécessaire pour assurer qu’une modification ultérieure de la nomenclature combinée ou une décision modifiant le classement desdits produits n’entraînera pas une réduction desdites limites quantitatives.
The Commission shall be empowered to adopt delegated acts in accordance with Article 16a in order to adapt the definition of quantitative limits laid down in Annex V and the categories of products to which they apply, where this proves necessary to ensure that any subsequent amendment to the combined nomenclature (CN) or any decision amending the classification of such products does not result in a reduction of such quantitative limits.

(15 bis) En vue d'assurer les adaptations techniques nécessaires à la liste des marchandises concernées par les préférences commerciales autonomes et l'instauration de contingents tarifaires lorsque les volumes des importations prises en compte dans le présent règlement dépassent certains seuils, le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union doit être délégué à la Commission en ce qui concerne la modification des annexes I et II en vue de la prise en compte des changements apportés à la nomenclature combinée et de l'instauration de nouveaux contingents tarifaires.
(15a) In order to make the necessary technical adaptations to the list of goods for which the autonomous trade preferences apply and to introduce tariff rate quotas where volumes of imports covered by this Regulation increase beyond certain levels the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of amending Annex I and Annex II to reflect changes in the combined nomenclature and to introduce new quotas.
