In its Conclusions of 12 December 2013 on the report from the Commission on EU Support for Democratic Governance, with a focus on the Governance Initiative, the Council noted that notwithstanding the partner country's needs and the commitment of the Union to provide predictable funding, elements of an incentive-based approach in programming can stimulate progress and results in democratic governance and should respond in a dynamic way to the level of commitment and progress with regards to human rights, democracy, the rule of law and good governance.

For the purposes of transparency and investor protection, Member States should require the following principles to apply to reporting on payments to governments in accordance with Chapter 10 of Directive 2013/34/EU: materiality (any payment, whether made as a single payment or a series of related payments, need not be taken into account in the report if it is below EUR 100 000 within a financial year); government and project-by-project reporting (reporting on payments to governments should be done on a government and project-by-project basis); universality (no exemptions, for instance for issuers active in certain countries, should be made which have a distortive impact and allow issuers to exploit lax transparency requirements); comprehensiveness (all relevant payments to governments should be reported, in line with Chapter 10 of Directive 2013/34/EU and supporting recitals).

2. Aux fins du présent accord, on entend par «informations classifiées» les informations et le matériel visés par le présent accord: i) dont la divulgation non autorisée pourrait, à différents degrés, porter préjudice aux intérêts du gouvernement des États-Unis ou de l'UE ou d'au moins l'un de ses membres; ii) qui doivent être protégés contre une divulgation non autorisée afin de préserver les intérêts du gouvernement des États-Unis ou de l'UE en matière de sécurité; et iii) qui comportent une classification de sécurité attribuée par le gouvernement des États-Unis ou par l'UE.
2. For the purpose of this Agreement ‘classified information’ shall mean information and material subject to this Agreement (i) the unauthorised disclosure of which could cause varying degrees of damage or harm to the interests of the USG, or of the EU or one or more of its Member States; (ii) which requires protection against unauthorised disclosure in the security interests of the USG or the EU; and (iii) which bears a security classification assigned by the USG or the EU.
