Selon les dispositions de l'article 7, paragraphe 1, premier alinéa, du règlement (CE) no 1663/95, la décision d'apurement des comptes visée à l'article 7, paragraphe 3, du règlement (CE) no 1258/1999 détermine, sans préjudice de décisions ultérieures conformément à l'article 7, paragraphe 4, de ce règlement, le montant des dépenses effectuées dans chaque État membre au cours de l'exercice financier concerné et devant être reconnu à la charge du FEOGA, section «Garantie», sur la base des comptes visés à l'article 6, paragraphe 1, point b), du règlement (CE) no 1258/1999 et des réductions et suspensions d'avances au titre de l'exercice concerné, y compris des réductions visées à l'article 4, paragraphe 3, deuxième alinéa, du règlement (CE) no 296/96.
In accordance with the first subparagraph of Article 7(1) of Regulation (EC) No 1663/95, the accounts clearance decision referred to in Article 7(3) of Regulation (EC) No 1258/1999 determines, without prejudice to decisions taken subsequently in accordance with Article 7(4) of the Regulation, the amount of expenditure effected in each Member State during the financial year in question recognised as being chargeable to the EAGGF Guarantee Section, on the basis of the accounts referred to in Article 6(1)(b) of Regulation (EC) No 1258/1999 and the reductions and suspensions of advances for the financial year concerned, including the reductions referred to in the second subparagraph of Article 4(3) of Regulation (EC) No 296/96.

These measures should also include provisions for the recovery of the advances paid by the Commission on the basis of the second subparagraph of Article 5(1) of Council Regulation (EC) No 1258/1999 of 17 May 1999 on the financing of the common agricultural policy (5) and for the amounts subjected to the voluntary modulation arrangements referred to in Articles 4 and 5 of Council Regulation (EC) No 1259/1999 of 17 May 1999 establishing common rules for direct support schemes under the common agricultural policy (6) .
