Par cet arrêt, la CJCE confirme son arrêt antérieur dans l’affaire Neri contre Italie de 2003, dans lequel elle avait établi que le refus de reconnaître une qualification obtenue dans le cadre d’un accord de franchise au seul motif que l’enseignement n’a pas été dispensé dans des locaux universitaires était contraire au droit communautaire.
By this ruling the ECJ confirms its earlier ruling in the case Neri against Italy of 2003 in which it had clarified that the refusal to recognise a qualification delivered through a franchise agreement for the only reason that education was not delivered on university premises was contrary to Community law.
