Si les soupçons selon lesquels un navire se livre au trafic de migrants par mer s'avèrent fondés, et sous réserve d'y être autorisées par l'État du pavillon conformément au Protocole contre le trafic illicite de migrants, les unités participantes peuvent prendre une ou plusieurs des mesures suivantes:

If, in the above cases, the suspicions regarding the nationality of the ship prove to be founded, measures referred to in paragraph 2.4 shall be taken under the conditions laid down in paragraph 2.5.2.1.

En réduisant la capacité exédentaire et en améliorant la planification des activités de pêche, diminuera le surinvestissement et l'inéfficience économique actuels; - établir une nouvelle typologie des activités de pêche (TAC pluriannuels, plurispécifiques, analytiques là ou celà s'avère nécessaire) dont les limites seraient définies par les droits existants, par les conditions économiques et sociales qui caractérisent chaque pêcherie; - développer des mécanismes de contrôle renforcés, en recourant notamment aux technologies modernes de localisation et de communication, afin de contrôler les mouvements des navires et d'informer les autorités compétentes, tout en assurant la coordination des informations obtenues; - garantir le respect des règles d'intérêt collectif, ce qui devrait se traduire d'une part par des incitations économiques favorisant le bon comportement des pêcheurs (utilisation d'engins sélectifs, respect des normes); d'autre part, par l'application de sanctions dissuasives au niveau communautaire (quotas de pénalisation, retrait de licences, non-octroi d'aides, etc); - renforcer la gestion des structures de pêche, d'une part, par la segmentation de la flotte de pêche, en tenant compte de nouveaux paramètres permettant d'apprécier et contrôler l'effort de pêche et, d'autre part, par l'intégration des actions structurelles dans la Réforme des Fonds; - améliorer la synergie entre la gestion des ressources internes et externes, les autres sources d'approvisionnement et la gestion des marchés.
Reducing excess capacity and improving the planning of fishing activities will reduce current overinvestment and economic inefficiency; - establishing a new classification of fishing activities (with multiannual, multispecies or analytical TACs where necessary) whose limits are defined by the existing rights and the socio-economic conditions characterizing each fishery; - developing strengthened control mechanisms employing modern location and communication techniques in order to monitor vessel movements and inform the competent authorities and at the same time guarantee coordination of the information obtained; - guaranteeing compliance with rules protecting the common interest, by providing economic incentives for fishermen's "good behaviour" (use of selective fishing gear, compliance with norms) and deterrent penalties at Community level (penalty quotas, withdrawal of licences, non-grant of aid, etc); - strengthening the management of fishery structures, by segmenting the fishing fleet, taking into account new parameters allowing the evaluation and control of fishing effort, and by integrating the structural measures into the reform of the structural Funds; - improving the synergy between the management of internal and external resources, market management and other supply sources.
