G. considérant que, le 12 janvier 2012, un navire russe qui aurait transporté des armes et/ou des munitions destinées au gouvernement syrien a atteint la Syrie après avoir été inspecté dans les eaux chypriotes, au large de Limassol; que ce navire, ayant pour destination le port syrien de Latakia, aurait été empêché par les douanes chypriotes de poursuivre son voyage parce que sa cargaison était suspecte; que des fonctionnaires des douanes chypriotes n'ont pas pu ouvrir quatre conteneurs transportés par le navire, ce qui a amené à penser que ceux-ci contenaient un "chargement dangereux", c'est-à-dire des armes et des munitions; que le ministère des affaires étrangères chypriote a confirmé que le navire avait été autorisé à poursuivre son trajet après que l'équipage et les armateurs russes eurent "donné l'assurance" qu'ils ne mettraient pas le cap sur la Syrie; que le navire serait parti de Saint-Pétersbourg au début du mois de décembre 2011;
G. whereas on 12 January 2012 it was reported that a Russian ship, allegedly carrying arms and/or munitions destined for the Syrian government had reached Syria after having been inspected in Cypriot waters off Limassol; whereas the ship, destined for the Syrian port city of Latakia, was reportedly prevented by Cypriot customs from continuing its journey because of its suspected cargo; whereas Cypriot custom officials were unable to open four containers on the ship, it was concluded they contained ‘dangerous cargo’ – i.e. arms and munitions; whereas the Cypriot Foreign Ministry confirmed that the ship was allowed to continue its journey after the crew of the ship and its Russian owners ‘provided assurances’ that it would not head for Syria; whereas the ship is believed to have set off from St Petersburg in early December 2011;

13. Considers that the Regulation should contain a new provision dealing with the opposability of choice-of-court agreements against third parties; takes the view that such provision could provide that a person who is not a party to the contract will be bound by an exclusive choice-of-court agreement concluded in accordance with the Regulation only if: (a) that agreement is contained in a written document or electronic record; (b) that person is given timely and adequate notice of the court where the action is to be brought; (c) in contracts for carriage of goods, the chosen court is (i) the domicile of the carrier; (ii) the place of receipt agreed in the contract of carriage; (iii) the place of delivery agreed in the contract of carriage, or (iv) the port where the goods are initially loaded on a ship or the port where the goods are finally discharged from a ship; considers that it should further be provided that, in all other cases, the third party may bring an action before the court otherwise competent under the Regulation if it appears that holding that party to the chosen forum would be blatantly unfair;

Une solution serait alors de mettre en œuvre l'article 15, 2ème phrase de la LLMC dans sa totalité en excluant tout simplement les personnes responsables de dommages causés par un navire ne battant pas pavillon d'un Etat partie à la LLMC du bénéfice de la limitation de responsabilité, laissant ainsi le soin au juge saisi d'appliquer ses règles de responsabilité civile de droit commun.
One possible solution would be to implement Article 15, second sentence, of the LLMC Convention in its entirety, quite simply excluding those responsible for damage caused by a ship not flying the flag of a state party to the LLMC from the benefits of limitation of liability, thus leaving it for the relevant court to enforce civil liability rules under general law.

Toutefois, l'introduction de la négligence grave comme critère à partir duquel la responsabilité du propriétaire d'un navire battant pavillon d'un État qui n'est pas partie contractante à la convention de 1996 ne serait plus limitée, doit être accueillie avec précaution.
On the other hand, caution would be the most advisable response to the use of serious misconduct as the criterion whereby a shipowner’s liability could not be limited if his ship were flying the flag of a state that was not a contracting party to the 1996 Convention and he were to be guilty of serious misconduct.

As these tankers will make up a major proportion of the end-of-life ships to be scrapped in the next few years, it might be worth considering action to supplement the relevant maritime safety legislation with rules on the clean and safe dismantling of the vessels.

* Il serait bon que les États membres soutiennent le travail d'étude de l'OMI concernant des méthodes de notification des émissions de gaz à effet de serre d'après les ventes de combustibles pour les opérations de transport maritime internationales, en vue de ventiler les émissions des navires dans les inventaires nationaux des parties à la convention-cadre des Nations unies sur les changements climatiques (CCNUCC).
* Member States should support the IMO's consideration of methodologies related to the reporting of greenhouse gas emissions based upon fuel sold to ships engaged in international transport, with a view to allocating ship emissions to national inventories of parties to the United Nations Framework Convention on Climate Change (UNFCCC).
