La directive Habitats prévoit dans son article 6 (paragraphes 3 et 4) que lorsqu'un projet est susceptible d'affecter un site Natura 2000 de manière significative, l'Etat membre procède à une évaluation du projet, qu'il étudie les alternatives et que si elles ne sont pas envisageables, il puisse justifier le projet par des raisons d'intérêt public majeur et offrir des compensations.
Article 6 (3) and (4) of the habitats directive says that where a project is likely to have a significant effect on a Natura 2000 site, the Member State concerned must carry out an assessment of the project and study the alternatives and, if there are no alternative solutions, it may nevertheless authorise the project for imperative reasons of overriding public interest and provide compensation.
