L’article 4, paragraphe 1, de la décision-cadre impose à chaque État membre de veiller à ce que toute décision de condamnation visant des ressortissants d’un autre État membre soit accompagnée, lors de l’inscription à son casier judiciaire, d’informations relatives à la nationalité ou aux nationalités de la personne condamnée. S’il en allait autrement, l’État membre de condamnation ne serait pas en mesure de transmettre des informations à l’État membre de nationalité et le principe de la centralisation des informations en un seul lieu serait inopérant.
Article 4(1) FD requires each Member State to ensure that all convictions of nationals of another Member State are accompanied by information on the nationality or nationalities of the convicted person, when provided to its criminal record. Otherwise, the convicting Member State would not be able to transmit information to the Member State of the person’s nationality, and the principle of centralising information in one place would not work.

3. 3. Once the time limit set out in Article 11(7) has elapsed, whenever a person asks the central authority of a Member State other than the Member State of the person’s nationality for information on his own criminal record, the central authority of the Member State in which the request is made shall submit a request to the central authority of the Member State of the person’s nationality for information and related data to be extracted from the criminal record in order to be able to include such information and related data in the extract to be provided to the person concerned.

When transmitting the information in accordance with Article 4, the central authority of the convicting Member State may inform the central authority of the Member State of the person’s nationality that the information on convictions handed down in the former Member State and transmitted to the latter central authority may not be retransmitted for any purposes other than that of criminal proceedings.

In addition to the obligations of a convicting Member State to transmit information to the Member States of the person’s nationality concerning convictions handed down against their nationals which this Framework Decision incorporates and further defines, an obligation on the Member States of the person’s nationality to store information so transmitted is also introduced, in order to ensure that they are able to reply fully to requests for information from other Member States.

3. When information extracted from the criminal record is requested from the central authority of the Member State of the person’s nationality by a third country, the Member State of the person’s nationality may reply in respect of convictions transmitted by another Member State only within the limitations applicable to the transmission of information to other Member States in accordance with paragraphs 1 and 2.

Cet index reprendrait uniquement les éléments permettant d’identifier la personne (nom, prénom, lieu et date de naissance, nationalité, etc.) et l’Etat membre dans lequel elle a déjà été condamnée, à l’exclusion de toute information sur le contenu et la forme de la condamnation, tout en respectant les législations nationales et le droit européen relatifs à la protection de la vie privée. Une fois identifié, grâce à l’index européen, l'Etat membre dans lequel la personne a été condamnée, un mécanisme sécurisé d'échanges entre ces deux autorités centrales leur permettra de s'échanger les informations.
In the first stage, a European index of offenders would be established, which would make it possible to see very quickly whether or not a person had a criminal conviction in any other Member State. The index would show only personal identification data (name, date and place of birth, nationality etc.), and the Member State in which the person had been convicted; it would not include any information on the crime, the sentence or the form of decision, and would comply in full with domestic legislation and European law on the protection of privacy.
