Furthermore, upon opposition by the proprietor of an earlier trade mark within the meaning of paragraph 2, the trade mark applied for shall not be registered where it is identical with, or similar to, the earlier trade mark and is to be registered for goods or services which are not similar to those for which the earlier trade mark is registered, where, in the case of an earlier Community trade mark, the trade mark has a reputation in the Community and, in the case of an earlier national trade mark, the trade mark has a reputation in the Member State concerned and where the use without due cause of the trade mark applied for would take unfair advantage of, or be detrimental to, the distinctive character or the repute of the earlier trade mark.

Le considérant 5 de la décision-cadre précise que cette dernière «ne vise pas à harmoniser les conséquences attachées par les différentes législations nationales à l’existence de condamnations antérieures et l’obligation de prendre en compte les condamnations antérieures prononcées dans d’autres États membres n’existe que dans la mesure où les condamnations nationales antérieures sont prises en compte en vertu du droit national».
Recital 5 of the Framework Decision states that "this Framework Decision does not seek to harmonise the consequences attached by the different national legislations to the existence of previous convictions, and the obligation to take into account previous convictions handed down in other Member States exists only to the extent that previous national convictions are taken into account under national law".

Each Member State shall ensure that , in the course of criminal proceedings brought against a person, its competent national authorities and courts or tribunals take into account previous convictions handed down in other Member States against the same person for different facts in accordance with their national law and attach to them the same legal effects as they attach to previous national convictions, provided that such persons are not treated more unfavourably than they would have been if the previous convictions had been national convictions.
