La législation nationale slovène indique que, pour évaluer la gravité de la peine, le juge doit notamment déterminer si l'infraction antérieure est du même type que la nouvelle, si les deux infractions ont été commises pour le même motif et combien de temps s’est écoulé depuis que la peine infligée lors de la condamnation antérieure a été exécutée, a fait l'objet d'une remise ou a été prescrite.
SI national law states that for the assessment of the severity of the sentence, the court shall in particular consider whether the earlier offence is of the same type as the new one, whether both offences were committed with the same motive, and how much time has elapsed since the previous conviction was served, remitted or statute-barred.
