The Commission has subscribed to this interpretation from the outset and considers that the solution we are working towards respects the basic structure of the Commission’s initial proposal, which is to, “define a terrorist offence on the basis of the identification of an objective factor: the terrorist act, accompanied by the identification of a subjective element: a terrorist motivation under the terms of the proposal”.
