Il n’y aurait pas double indemnisation si les frais de téléchargement ne s’appliquaient que sur la production de la copie initiale sur le disque dur de l’ordinateur et n’incluaient pas l’autorisation de faire d’autres copies; ou si l’acheteur de la musique téléchargée avait seulement l’intention de conserver le fichier sur son disque dur et n’avait pas besoin d’acheter de CD ni d’autre support d’enregistrement vierge.
There would be no double compensation if the downloading charge applied only to the making of an initial copy on the hard drive of the computer and did not include permission to make a subsequent copy; or if the purchaser of a download only intended to retain the file on hard drive and had no need to purchase a CD or other blank recording medium.
