B. whereas the request for defence relates to the allegedly defamatory opinions expressed by Mr Albertini in a written question that he put to the Italian Minister of Justice on 22 October 2012 with a view to establishing whether the conduct of Alfredo Robledo, a prosecutor who had initiated an investigation into facts involving the municipality of Milan and relating to Mr Albertini’s functions as mayor of that city back in 2005, constituted a breach of professional ethics and was hence subject to disciplinary proceedings;

8. fait observer que les dispositions relatives aux aides d'État en vigueur dans l'Union manquent de souplesse à certains égards et donnent souvent lieu à une insécurité juridique, qui freine les investissements prévus; demande dès lors à la Commission d'étudier dans quelle mesure les dispositions du droit pourraient être simplifiées afin de créer un contexte plus favorable aux investissements, de manière à encourager les investissements et l'innovation, et supprimer tout obstacle à la diffusion du haut débit, en particulier dans les zones où ils auraient autrement été improductifs; considère que les lignes directrices communautaires pour l'application des règles relatives aux aides d'État dans le cadre du déploiement rapide des réseaux de communication à haut débit devraient en outre servir à clarifier la création d'entreprises publiques spécialisées dans l'internet à haut débit et l'établissement de partenariat entre municipalités ou sur le modèle "partenariat public-privé"; invite la Commission et l'organe des régulateurs européens des communications électroniques (ORECE), en consultation avec les autorités nationales, à faciliter les partenariats public-privé et à déployer d'autres instruments européens de financement, notamment les fonds du FEDER, de la BEI et de la BERD;

Notes that European law on aid, as it currently stands is in some respects rigid and frequently leads in practice to legal uncertainty, hampering planned investment; calls, therefore, on the Commission to examine to what extent the rules could be simplified in order to establish a more investment-friendly framework so as to promote investment and innovation and remove obstacles to broadband roll-out particularly in those areas where they would otherwise have been unprofitable; considers that the Community Guidelines for the application of State aid rules in relation to rapid deployment of broadband networks should, in addition, serve to clarify the setting up of public broadband companies and the cooperation between municipalities and public-private partnership models; calls on the Commission and the Body of European Regulators for Electronic Communications (BEREC), in consultation with public authorities, to facilitate public-private partnerships and employ other European sources of financing, not least ERDF, EIB, and EBRD funds;
