D. considérant que, le 17 juillet 2014, Thulani Maseko et Bheki Makhubu ont été condamnés pour outrage à la Cour par la High Court du Swaziland et condamnés à deux ans d'emprisonnement, peine manifestement disproportionnée par rapport à celle habituellement prononcée dans des cas similaires, à savoir 30 jours d'emprisonnement avec possibilité de payer une amende; considérant que le juge présidant au procès, Mpendulo Simelane, avait été cité dans un des articles publiés par le magazine de M. Maseko, et qu'il y a donc là conflit d'intérêt flagrant et obstacle à la tenue d'un procès équitable;
D. whereas, on 17 July 2014, Thulani Maseko and Bheki Makhubu were convicted for contempt of court by the High Court of Swaziland and sentenced to two years’ imprisonment, a ruling which seems disproportionate compared with the usual sentence – 30 days’ imprisonment with the option of paying a fine – imposed in similar cases; whereas the judge presiding the trial, Mpendulo Simelane, had been named in one of the articles published by Mr Maseko’s newspaper, and whereas this represents a clear conflict of interest and an impediment to a fair trial;
