Lorsque l’autorité compétente de l’État d’exécution a décidé d’invoquer un motif de refus visé au paragraphe 1 du présent article, en particulier les motifs visés au paragraphe 1, point d) ou k), elle peut décider néanmoins, en accord avec l’autorité compétente de l’État d’émission, de surveiller la mesure de probation ou peine de substitution prononcée dans le cadre du jugement et, le cas échéant, la décision de probation qui lui a été transmise, sans avoir à assumer la responsabilité quant à la prise des décisions visées à l’article 14, paragraphe 1, points a), b) et c).
4. Where the competent authority of the executing State has decided to invoke a ground for refusal referred to in paragraph 1 of this Article, in particular the grounds referred to under paragraph 1(d) or (k), it may nevertheless, in agreement with the competent authority of the issuing State, decide to supervise the probation measures or alternative sanctions that are imposed in the judgment and, where applicable, the probation decision forwarded to it, without assuming the responsibility for taking any of the decisions referred to in Article 14(1)(a), (b) and (c).
