L’article 5 du statut des fonctionnaires de l’Union européenne, dans sa version issue du règlement (CE, Euratom) no 723/2004 du Conseil, du 22 mars 2004, modifiant le statut des fonctionnaires des Communautés européennes ainsi que le régime applicable aux autres agents de ces Communautés, tel que modifié en dernier lieu par le règlement (UE, Euratom) no 1240/2010 du Conseil, du 20 décembre 2010 (ci-après le « statut »), est libellé comme suit :
Article 5 of the Staff Regulations of Officials of the European Union, in the version resulting from Council Regulation (EC, Euratom) No 723/2004 of 22 March 2004 amending the Staff Regulations of officials of the European Communities and the Conditions of Employment of other servants of the European Communities, as last amended by Council Regulation (EU) No 1240/2010 of 20 December 2010 (‘the Staff Regulations’) reads as follows:

Recours en annulation, introduit sur le fondement de l’article 263 TFUE, à l’encontre de l’article 1er, point 70, du règlement (UE, Euratom) no 1023/2013 du Parlement européen et du Conseil, du 22 octobre 2013, modifiant le statut des fonctionnaires de l’Union européenne et le régime applicable aux autres agents de l’Union européenne (JO L 287, p. 15), en ce que celui-ci modifie l’annexe X du règlement no 31 (CEE)/11 (CEEA), fixant le statut des fonctionnaires et le régime applicable aux autres agents de la Communauté économique européenne et de la Communauté européenne de l’énergie atomique (JO 1962, 45, p. 1385).
Action for annulment brought under Article 263 TFEU against point 70 of Article 1 of Regulation (EU, EURATOM) No 1023/2013 of the European Parliament and of the Council of 22 October 2013 amending the Staff Regulations of Officials of the European Union and the Conditions of Employment of Other Servants of the European Union (OJ 2013 L 287, p. 15), in so far as it amends Annex X to Regulation No 31 (EEC), 11 (EAEC), laying down the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Economic Community and the European Atomic Energy Community (OJ 1962, 45, p. 1385).

Annul the Commission’s decision resulting from the ‘Rights’ page of the SYSPER site and confirmed by Commission Decision No R/396/14 of 2 July 2014 rejecting a complaint, to allocate the applicant, from 1 January 2014, 2.5 days of additional leave in respect of ‘home leave’ instead of 5 days ‘travelling time’, to which he was entitled previously, on the basis of the first paragraph of Article 7 of Annex V to the Staff Regulations of Officials of the European Union, as amended by Regulation No 1023/2013 of the European Parliament and of the Council of 22 October 2013 amending the Staff Regulations of Officials of the European Union and the Conditions of Employment of Other Servants of the European Union;
