Bruxelles, le 3 avril 2012 - La Commission européenne a ouvert deux procédures formelles d’examen à l’encontre de Motorola Mobility Inc. Elle entend déterminer si Motorola a utilisé de façon abusive, en violation des engagements pris envers des organismes de normalisation, certains de ses brevets essentiels liés à des normes dans le but de fausser la concurrence sur le marché intérieur, enfreignant en cela les règles de l’UE sur les ententes et abus de position dominante.

The Commission will assess whether Motorola has abusively, and in contravention of commitments it gave to standard setting organisations, used certain of its standard essential patents to distort competition in the Internal Market in breach of EU antitrust rules.

Le 21 décembre 2012, la Commission a adopté une communication des griefs dans laquelle elle estimait, à titre préliminaire, que l’introduction par Samsung, sans aucune justification objective, d’injonctions de cessation à titre préliminaire et permanent contre Apple Inc (ci-après «Apple») devant les juridictions de différents États membres et fondées sur ses brevets essentiels pour la norme liée à la technologie UMTS (système universel de télécommunications mobiles) suscitait des préoccupations au regard de l’article 102 TFUE et de l’article 54 de l’accord EEE.
On 21 December 2012, the Commission adopted a Statement of Objections (‘SO’), in which it reached the preliminary view that Samsung’s seeking of preliminary and permanent injunctions against Apple Inc (‘Apple’) before the courts of various Member States on the basis of its standard essential patents (‘SEPs’) covering the Universal Mobile Telecommunications Service (‘UMTS’) technology without any objective justification, raised concerns under Article 102 TFEU and Article 54 of the EEA Agreement.
