Welcomes the decision of the Ministerial Conference of 3 November 2008, which duly took note of the recommendation adopted by the EMPA in Jordan on 13 October 2008; supports the decision to bring a strong parliamentary dimension to the Union for the Mediterranean, thereby reinforcing its democratic legitimacy, by building on the EMPA, which should be further consolidated and its work better articulated with that of the other institutions of the Partnership, with the possibility being envisaged of granting it legal personality and entitling it to propose and assess economic and regional integration strategies and projects and allowing it to make recommendations to the meetings of foreign affairs ministers; expects this recognition of the EMPA as an institution also to be reflected by its participating as an observer at all meetings of the executive, at meetings of the Heads of State and Government, at ministerial meetings and at the preparatory meetings of senior officials;

(4) La décision n° 1600/2002/CE du Parlement européen et du Conseil du 22 juillet 2002 établissant le sixième programme d'action communautaire pour l'environnement(6) souligne la nécessité d'adopter une approche fondée sur la connaissance pour élaborer, mettre en oeuvre et évaluer la politique environnementale et insiste en particulier sur la mise en place d'une surveillance des multiples fonctions des forêts, conformément aux recommandations d'instances telles que la conférence ministérielle sur la protection des forêts en Europe, le forum des Nations unies sur les forêts ou encore la convention sur la diversité biologique.
(4) Decision No 1600/2002/EC of the European Parliament and of the Council of 22 July 2002 laying down the sixth Community environment action programme(6) identifies the need to base the drawing-up, implementation and evaluation of environmental policies on a knowledge-based approach and, in particular, the need for monitoring the multiple roles of forests in line with recommendations adopted by the Ministerial Conference on the Protection of Forests in Europe and the United Nations Forum on Forests and the Convention on Biodiversity and other forums.

(6) Le sixième programme communautaire d'action pour l'environnement souligne la nécessité d'adopter une approche fondée sur la connaissance pour élaborer, mettre en œuvre et évaluer la politique environnementale et insiste en particulier sur la mise en place d'une surveillance des multiples fonctions des forêts, conformément aux recommandations d'instances telles que la conférence ministérielle sur la protection des forêts en Europe, le forum des Nations Unies sur les forêts, la Convention sur la diversité biologique ou encore la Convention-cadre des Nations unies sur le changement climatique .
(6 ) The Sixth Environment Action Programme of the European Community identifies the need to base the formulation , implementation and evaluation of environmental policies on a knowledge-based approach and, in particular, the need to monitor the multiple roles of forests in line with recommendations adopted by the Ministerial Conference on the Protection of Forests in Europe, the United Nations Forum on Forests, the Convention on Biological Diversity, the United Nations Framework Convention on Climate Change and other fora.

La représentante ministérielle recommande encore une approche de prédilection face à l'article 89 de la Loi : reconnaître la compétence des Premières nations quand il s'agit de traiter de cette question, d'exercer leur pouvoir sur les intérêts immobiliers grevés sur leurs terres, y compris les règles touchant la dispense prévue à l'article 69 de la Loi sur les Indiens.
The ministerial representative goes on to recommend that the preferred approach with regard to section 89 of the act would be to recognize First Nations jurisdiction to deal with this issue, to exercise jurisdiction over encumbering property interests in their land, including rules affecting the exemption of section 69 of the Indian Act.

Rappelant que le gouvernement fédéral n’a pas encore élaboré de politique de consultation applicable à ce genre de situation, la représentante ministérielle recommande dans son rapport que « des efforts soient déployés pour régler cette importante lacune dans la politique fédérale, et cela, le plus tôt possible.
Noting that the federal government has yet to develop a consultation policy to be used in situations such as this, the ministerial representative recommended that “efforts be made to address this large gap in federal policy as soon as possible . includ[ing] developing a companion set of practices and procedures for monitoring, recording and assessing concerns about consultations made by First Nation representatives throughout the process”.

Rappelant que le gouvernement fédéral n’a pas encore élaboré de politique de consultation applicable à ce genre de situation, la représentante ministérielle recommande dans son rapport que « des efforts soient déployés pour régler cette importante lacune dans la politique fédérale, et cela, le plus tôt possible.
