Lors de la signature à Luxembourg le 25 juin 2005 de la révision de l’accord de partenariat ACP-CE, les parties ont fait une déclaration commune spécifiant que «le Conseil des ministres ACP-CE examinera, en vertu des dispositions visées à l’article 100 de l’accord de Cotonou, les propositions des États ACP concernant l’annexe II dudit accord relative aux fluctuations à court terme des recettes d’exportations».
At the signing of the revised ACP-EC Partnership Agreement in Luxembourg on 25 June 2005, the Parties made a joint declaration that: ‘The ACP-EC Council of Ministers will examine, in application of the provisions contained in Article 100 of the Cotonou Agreement, the proposals of the ACP side concerning Annex II thereof on short-term fluctuations in export earnings’.

Par lettre du 25 avril 2001, la Commission a transmis au Parlement sa communication sur la proposition de décision du Conseil relative à la position à adopter par la Communauté au sein du Conseil des ministres ACP-UE concernant le solde de l'ensemble des prêts spéciaux accordés aux pays pauvres très endettés (PPTE) ACP faisant partie des pays les moins avancés (PMA), qui subsisterait après l'application de tous les autres mécanismes d'allégement de la dette des PPTE (COM(2001) 210 – 2001/2158(COS)).
By letter of 25 April 2001 the Commission forwarded to Parliament its Communication on the proposal for a Council decision on the adoption of the position of the Community within the ACP-EC Council of Ministers regarding the settlement of all ACP HIPC LDCs’ special loans remaining after full application of HIPC debt alleviation mechanisms (COM(2001) 210 – 2001/2158(COS)).

En tout état de cause, l'application de la mesure proposée exige l'autorisation des pays ACP, puisque des crédits du FED sont en jeu à hauteur de 60 millions et, en ce qui concerne les délibérations du Conseil des ministres ACP du 6 décembre, il est à supposer que la Commission ait procédé à la mise en œuvre de la décision sans attendre la décision commune; en outre, le Conseil des ministres ACP s'est déclaré préoccupé par l'habitude que semble avoir commencé à contracter la Commission, à savoir l'affectation de crédits du FED non encore alloués sans consultation du groupe ACP ni prise en compte de la procédure décisionnelle.
In any event, implementation of the proposed measure requires authorisation from the ACP, since there are 60 million euros’ worth of EDF funds involved – although it may be inferred from the discussions which took place during the 6 December ACP Council of Ministers meeting that the Commission has already implemented the decision without awaiting the joint decision. Furthermore, the ACP Council of Ministers has expressed its concern at what is becoming a habit on the Commission’s part, namely awarding unassigned EDF Funds without consulting the ACP Group and without taking into account the rules governing the decision-making process.

The names, positions and addresses of the Chairman-in-Office of the Committee of ACP Ambassadors, the Secretary or Secretaries and Deputy Secretary or Deputy Secretaries of the Council of ACP Ministers and of the permanent members of the staff of the Secretariat of the ACP States shall be communicated periodically by the President of the Council of ACP Ministers to the Government of the State in whose territory the Council of ACP Ministers is established.
