Après la publication du décret par le gouvernement italien et la réunion du groupe transit à Munich, le Commissaire Van Miert avait adressé une nouvelle lettre au Ministre Berlini (voir IP 850 du 19/10/90) dans laquelle il attirait l'attention du gouvernement italien sur l'incompatibilité du décret ministériel avec le droit communautaire.
