La Commission européenne, à l'initiative de M. Karel Van Miert, avait indiqué clairement qu'elle subordonnait toute décision dans le dossier de VW Baunatal à un engagement formel et juridiquement contraignant des autorités fédérales de récupérer au préalable une aide illégale versée à VW Saxe par le Land de Saxe.
At the initiative of Mr Van Miert, the Commission had previously made it clear that it would take a decision in the Kassel/Baunatal case only when it had received a formal and legally binding undertaking from the federal authorities that aid which had been paid out unlawfully to VW by the government of Saxony would be recovered.

As regards the great majority of the firms concerned, namely those with fewer than 50 employees (i.e. some 11 700 firms) and provided that the Community rules applying to them are observed (i.e. an aid ceiling of ECU 100 000 over a maximum period of three years), Mr Van Miert made it clear to the French authorities that he had no objections to this aspect of the case: indeed, such aid did not even have to be formally notified to the Commission. Furthermore, the Commission wholeheartedly supports the objective of creating jobs, particularly for young people.
