During the same initial transitional period of seven years, for Member States which ratify, or accede to, this Agreement after the entry into force thereof, the contributions shall be calculated on the basis of the number of European patents having effect in the territory of the ratifying or acceding Member State on the date of the ratification or accession and the number of European patents with respect to which actions for infringement or for revocation have been brought before the national courts of the ratifying or acceding Member State in the three years preceding the ratification or accession.

1. Lorsqu'un État membre négocie un accord intergouvernemental ou une modification d'un accord intergouvernemental existant sans parvenir à déterminer clairement, sur la base de sa propre appréciation, si l'accord intergouvernemental ou la modification en cours de négociation est compatible avec le droit de l'Union, il en informe la Commission avant la clôture des négociations et lui soumet le projet d'accord ou de modification avec leurs annexes éventuelles.
1. Where a Member State is negotiating an intergovernmental agreement or an amendment to an existing intergovernmental agreement and it has been unable, on the basis of its own assessment, to reach a firm conclusion as to the compatibility of the intergovernmental agreement or amendment under negotiation with Union law, it shall inform the Commission thereof before the closure of the negotiations and submit the draft agreement or amendment together with any annexes to it.

La clause visée au point (a) doit être libellée de la manière suivante: "( nom de l'État membre) dénoncera le présent accord, en partie ou dans sa totalité , au cas où la Communauté européenne ou la Communauté européenne et ses États membres concluraient un accord avec (nom du pays tiers/des pays tiers ) sur les mêmes questions de justice civile que celles qui sont régies par le présent accord.
The clause referred to in point (a) should be worded along the following lines : "(the name of the Member State) shall denounce this agreement in part or in full if and when the European Community or the European Community and its Member States conclude an agreement with (the name of the third country or third countries) on the same matters of civil justice as those governed by this agreement".

That clause shall be worded taking into account the following guidelines: “(the name of the Member State) shall denounce this agreement in part or in full if and when the Community or the Community and its Member States conclude an agreement with (the name of the third country or third countries) on the same matters of civil justice as those governed by this agreement”.

The agreement shall include the following clause : "(the name of Member State) will denounce the agreement when the European Community concludes an agreement with (the name of the third country) on the same subject matters of civil justice as governed by the present agreement".

Par ailleurs, tout avantage accordé par un membre aux ressortissants d'un autre membre doit être accordé, immédiatement et sans condition, aux ressortissants de tous les autres membres même si ce traitement est plus favorable que celui que le pays membre en question accorde à propres ressortissants.
Moreover, any advantage granted by a member to nationals of another member must be accorded immediately and unconditionally to the nationals of all other members even if this treatment is more favourable than that accorded to its own nationals.

Without prejudice to Article 37, if the Council of Members decides that any Member is in breach of its obligations under this Agreement and decides further that such breach significantly impairs the operation of this Agreement, it may, by reasoned decision of the other Members taken in the absence of the Member concerned, exclude that Member from this Agreement.

(2) Whereas this dispensation relates in particular to agreements, decisions and concerted practices where the only parties thereto are undertakings from one Member State and the agreements, decisions or practices do not relate either to imports or exports between Member States, or where not more than two undertakings are party thereto and the agreements only restrict the freedom of one party to the contract in determining the prices or conditions of business on which the goods he has obtained from the other party to the contract may be resold; whereas this dispensation does not cover mot agreements caught by Articles 81(1) of the Treaty which are entered into by two or more undertakings, each operating, for the purposes of the agreement, at a different level of the production or distribution chain, and which relate to the conditions under which the parties may purchase, sell or resell certain goods or services ("vertical agreements");
