Subject to the specific circumstances of each case, the state of vulnerability should not constitute an obstacle for the suspected or accused person to have access to material evidence held by the competent authorities with regard to the criminal case in question in the exercise of their procedural rights and with a view to the right to effective remedies.

1. 1. Persons excluded on grounds of public policy or public security may submit an application for lifting of the exclusion order after a reasonable period, depending on the circumstances, and in any event after three years from enforcement of the final exclusion order which has been validly adopted in accordance with Community law, by putting forward arguments to establish that there has been a material change in the circumstances which justified the decision ordering their exclusion.

2. Lorsqu'une décision d'éloignement, telle que visée au paragraphe 1, est exécutée plus de deux ans après qu'elle a été prise, l'État membre vérifie l'actualité et la réalité de la menace pour l'ordre public ou la sécurité publique que représente la personne concernée, et évalue si un changement matériel des circonstances est intervenu depuis le moment où la décision d'éloignement avait été prise.
2. If an expulsion order, as provided for in paragraph 1, is enforced more than two years after it was issued, the Member State shall check that the individual concerned is currently and genuinely a threat to public policy or public security and shall assess whether there has been any material change in the circumstances since the expulsion order was issued.

2. La personne qui a fait l’objet d’une mesure d’éloignement du territoire pour des raisons d’ordre public, sécurité publique ou santé publique, peut introduire une nouvelle demande d’accès au territoire après un délai raisonnable en fonction des circonstances, et au plus tard après deux ans à compter de la décision d’éloignement valablement prise au sens du droit communautaire, en invoquant des moyens tendant à établir un changement matériel des circonstances qui avaient justifié la décision d’éloignement.
(2) After a reasonable period, depending on the circumstances, and in any event once two years have elapsed since the decision ordering their expulsion was validly adopted in accordance with Community law, persons expelled on grounds of public policy, public security or public health, may submit a new application for leave to enter by putting forward arguments to establish that there has been a material change in the circumstances which justified the first decision ordering their expulsion.

Furthermore, a measure denying entry to a Member State (or a deportation order) cannot remain in force for an indefinite period of time but must be reassessed over time and new factors must be taken into consideration, in particular any material change in the circumstances which justified the measures.
