En mars 2012, la Commission confirmait qu’elle avait demandé à cinq grands opérateurs de télécommunications (à savoir Deutsche Telecom, France Télécom, Telefónica, Vodafone et Telecom Italia, également dénommés «E5») ainsi qu’à l’association du secteur de la téléphonie mobile (GSMA) de lui fournir des informations sur la définition des normes applicables aux futurs services de communication mobile.
In March 2012 the Commission confirmed that it had requested information from five large telecom operators (the "E5": Deutsche Telecom, France Télécom, Telefónica, Vodafone and Telecom Italia) and from the mobile sector association GSMA about the way standards for future mobile communications services are being developed.

Dans son arrêt du 13 mai 2003 concernant l'affaire C-463/00, la Cour de justice a dit pour droit qu’en maintenant en vigueur les dispositions des articles 2 et 3, paragraphes 1 et 2, de la loi n° 5/1995 portant régime juridique de l'aliénation de participations publiques dans certaines entreprises, du 23 mars 1995, ainsi que les décrets royaux relatifs à Repsol SA, Telefónica de España SA, Telefónica Servicios Móviles SA, Argentaria, Tabacalera SA et Endesa SA, dans la mesure où ils prévoient l'application d'un régime d'autorisation administrative préalable, le royaume d'Espagne a manqué aux obligations qui lui incombent en vertu des règles du traité CE en matière de libre circulation des capitaux (article 56).
In its ruling of 13 May 2003 in Case C-463/00, the Court of Justice found that, by maintaining in force the provisions of Article 2 and Article 3(1) and (2) of Law 5/1995 on the legal arrangements for disposal of public shareholdings in certain undertakings of 23 March 1995, as well as Royal Decrees on Repsol SA, Telefónica de España SA, Telefónica Servicios Móviles SA, Argentaria, Tabacalera SA, and Endesa SA, in so far as they implement a system of prior administrative approval, Spain had failed to fulfil its obligations under EC Treaty rules on the free movement of capital (Article 56).
