La présente directive ne devrait pas porter atteinte aux procédures d’information et de consultation visées par la directive 2002/14/CE du Parlement européen et du Conseil du 11 mars 2002 établissant un cadre général relatif à l’information et à la consultation des travailleurs dans la Communauté européenne (4) et aux procédures spécifiques visées à l’article 2 de la directive 98/59/CE du Conseil du 20 juillet 1998 concernant le rapprochement des législations des États membres relatives aux licenciements collectifs (5) et à l’article 7 de la directive 2001/23/CE du Conseil du 12 mars 2001 concernant le rapprochement des législations des États membres relatives au maintien des droits des travailleurs en cas de transfert d’entreprises, d’établissements ou de parties d’entreprises ou d’établissements (6).
This Directive should be without prejudice to the information and consultation procedures referred to in Directive 2002/14/EC of the European Parliament and of the Council of 11 March 2002 establishing a general framework for informing and consulting employees in the European Community (4) and to the specific procedures referred to in Article 2 of Council Directive 98/59/EC of 20 July 1998 on the approximation of the laws of the Member States relating to collective redundancies (5) and Article 7 of Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees’ rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses (6).

(16) Employees" rights should remain subject to Community law and its implementation in Member States, in particular Council Directive 94/45/EC of 22 September 1994 on the establishment of a European Works Council or a procedure in Community-scale undertakings and Community-scale groups of undertakings for the purposes of informing and consulting employees, Council Directive 98/59/EC of 20 July 1998 on the approximation of the laws of the Member States relating to collective redundancies, Council Directive 2001/23/EC of 12 March 2001 on the approximation of the law of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses and Directive 2002/14/EC of the European Parliament and of the Council of 11 March 2002 establishing a general framework for informing and consulting employees in the European Community.

However, where the debtor is an insurance undertaking or a credit institution as defined in Directive 2001/17/EC of the European Parliament and of the Council of 19 March 2001 on the reorganisation and winding-up of insurance undertakings (7) and Directive 2001/24/EC of the European Parliament and of the Council of 4 April 2001 on the reorganisation and winding up of credit institutions (8), respectively, the only insolvency proceedings in which a Community trademark may be involved are those opened in the Member State where that undertaking or institution has been authorised.

(4) La présente directive est adoptée dans un contexte juridique européen constitué notamment de la directive 98/26/CE ainsi que de la directive 2001/24/CE du Parlement européen et du Conseil du 4 avril 2001 concernant l'assainissement et la liquidation des établissements de crédit(6) et de la directive 2001/17/CE du Parlement européen et du Conseil du 19 mars 2001 concernant l'assainissement et la liquidation des entreprises d'assurance(7) et du règlement (CE) n° 1346/2000 du Conseil du 29 mai 2000 relatif aux procédures d'insolvabilité(8).
(4) This Directive is adopted in a European legal context which consists in particular of the said Directive 98/26/EC as well as Directive 2001/24/EC of the European Parliament and of the Council of 4 April 2001 on the reorganisation and winding up of credit institutions(6), Directive 2001/17/EC of the European Parliament and of the Council of 19 March 2001 on the reorganisation and winding-up of insurance undertakings(7) and Council Regulation (EC) No 1346/2000 of 29 May 2000 on insolvency proceedings(8).

- Les directives 80/987/CEE du 20 octobre 1980 (concernant le rapprochement des législations des États membres relatives à la protection des travailleurs salariés en cas d'insolvabilité de l'employeur) et 2001/23/CE du 12 mars 2001 (concernant le rapprochement des législations des États membres relatives au maintien des droits des travailleurs en cas de transfert d'entreprises, d'établissements ou de parties d'entreprises ou d'établissements) obligent les États membres à prendre les mesures nécessaires pour protéger les droits à pension complémentaire des travailleurs.
