Le considérant 8 de la directive dispose: «Dans le monde, un grand nombre des organismes existants reconnus par les parties contractantes de l'Organisation maritime internationale (OMI) n'assurent pas une mise en œuvre adéquate des règles ou une fiabilité suffisante lorsqu'ils agissent au nom des administrations nationales, dans la mesure où ils ne disposent pas des structures ni d'une expérience fiables et adéquates pour pouvoir accomplir leur mission de manière hautement professionnelle».
Recital (8) of the Directive provides that: "Worldwide a large number of the existing organisations recognised by International Maritime Organisation (IMO) Contracting Parties do not ensure either adequate implementation of the rules or sufficient reliability when acting on behalf of national administrations as they do not have reliable and adequate structures and experience to enable them to carry out their duties in a highly professional manner".

For the purposes of this Regulation, a third country or an OCT shall be considered to be neighbouring a Member State, including its outermost regions, where the third country or the OCT and that Member State share a common land border or where both the third country or OCT and the Member State are eligible under a joint maritime cross-border or transnational programme under the European territorial cooperation goal, or are eligible under another cross-border, sea-crossing or sea-basin cooperation programme, including where they are separated by international waters.

If a ship flying the flag of the Member State concerned has been detained by a port State, the administration shall oversee the ship being brought into compliance with the relevant International Maritime Organization (IMO) Conventions.

Such limiting measures are of essential importance to ensure that protective mechanisms of the Community’s maritime transport sector do not lose their credibility and thereby their justification in light of Community law when they are extended to activities not subject to the international competitive pressures which the maritime transport sector is subject to.
