(11 bis) Tout document visant à clarifier la pratique établie de la Commission en ce qui concerne l'application du présent règlement (y compris les quatre projets d'orientations relatives au choix d'un pays analogue, aux réexamens au titre de l'expiration et à la durée des mesures, à la marge de préjudice et à l'intérêt de l'Union) ne devrait être adopté par la Commission qu'après l'entrée en vigueur du présent règlement et après consultation du Parlement européen et du Conseil et devrait donc tenir pleinement compte du contenu du présent règlement.
(11a) Any document aimed at clarifying the established practices of the Commission with regard to the application of this Regulation (including the four draft guidelines on the selection of analogue country, on expiry reviews and the duration of measures, on the injury margin and on the Union interest) should be adopted by the Commission only after entry into force of this Regulation and proper consultation of the European Parliament and Council and should then fully reflect the content of this Regulation.

Following the provisional disclosure, the Iranian exporter commented that its injury margin was overstated since the weighted average unit sales price established was understated, incorrectly calculating the amount of level of trade adjustment; however, no alternative quantification of the level of trade adjustment was proposed.

The Iranian exporter commented that its injury margin was overstated since the weighted average unit sales price established was understated due to an incorrect calculation of the amount of level of trade adjustment.

Il convient de rappeler que, conformément à l’article 9, paragraphe 4, du règlement de base et comme le précise le considérant 49 du règlement (CE) no 1995/2000, le droit définitif, lors de l’enquête initiale, a été établi au niveau de la marge de préjudice constatée, qui était inférieure à la marge de dumping, car il a été estimé que ce montant moindre suffirait à éliminer le préjudice subi par l’industrie de l’Union.
It is reminded that, in accordance with Article 9(4) of the basic Regulation and as outlined in recital (49) of Regulation (EC) No 1995/2000, the definitive duty in the original investigation was established at the level of the injury margin found, which was lower than the dumping margin because it was found that such lesser duty would be adequate to remove the injury to the Union industry.
