Certaines pratiques œnologiques sont particulièrement exposées au risque d’une utilisation frauduleuse et doivent être indiquées dans les registres et les documents d’accompagnement conformément au règlement (CE) no 436/2009 de la Commission du 26 mai 2009 portant modalités d’application du règlement (CE) no 479/2008 du Conseil en ce qui concerne le casier viticole, les déclarations obligatoires et l’établissement des informations pour le suivi du marché, les documents accompagnant les transports des produits et les registres à tenir dans le secteur vitivinicole (3).
Certain oenological practices are particularly exposed to the risk of fraudulent use and must be indicated in the registers and accompanying documents in accordance with Commission Regulation (EC) No 436/2009 of 26 May 2009 laying down detailed rules for the application of Council Regulation (EC) No 479/2008 as regards the vineyard register, compulsory declarations and the gathering of information to monitor the wine market, the documents accompanying consignments of wine products and the wine sector registers to be kept (3).

5. rappelle que la répartition des crédits communautaires des autres secteurs agricoles qui ont été réformés dans le cadre de la nouvelle PAC par la création d'enveloppes nationales a été effectuée en se fondant sur la logique du découplage total ou partiel des subventions communautaires; souligne que la nouvelle OCM du secteur vitivinicole devra reposer sur la mise en œuvre de mesures homogènes, communes à tous les États membres, et sur des mesures relevant de la subsidiarité permettant de tenir compte des besoins spécifiques du secteur dans chaque État membre ou région de production; ajoute que, dans chaque État membre, le secteur (production, commerce, interprofession, régions de production ...), en lien avec l'administration régionale et nationale, définirait, par le biais d'une série de programmes, la manière d'atteindre l'objectif d'adaptation de la production au marché, en utilisant une ou plusieurs mesures parmi celles définies dans le cadre des enveloppes nationales; considère que les mesures relevant de la subsidiarité doivent être définies et encadrées au niveau européen afin d'éviter des distorsions de concurrence et être entièrement financées par le budget communautaire;

Recalls that the distribution of Community funds in other agricultural sectors reformed within the framework of the new CAP by creating "national envelopes" took place by adopting an approach based on the full or partial decoupling of Community aid; stresses that the new CMO in wine must be based on the implementation of uniform measures, common to all Member States, and on measures within the scope of subsidiarity that make it possible to take account of the sector's specific needs in all Member States and production regions; adds that in each Member State the sector (production, trade, inter-trade bodies, production regions, etc.), in cooperation with the regional and national administration, should set out, by means of a series of programmes, how to achieve the aim of adapting production to the market by means of one or more of the measures among those defined in the context of the national envelopes; considers that the measures coming within the scope of subsidiarity must be defined and supervised at European level, to prevent distortions of competition, and must be entirely financed by the Community budget;

27. estime qu'il conviendra de procéder de manière prudente et transparente pour la réattribution progressive des nouveaux droits de plantation, ce qui peut permettre d'éviter un développement incontrôlable du potentiel vitivinicole de l'Union européenne ayant des effets négatifs sur le marché; estime que les États membres doivent présenter des programmes qui reprendront le niveau de plantation ciblé, le bilan de l'évolution de l'octroi des droits, les variétés concernées dans chaque région et le calendrier d'application; souligne que les nouveaux droits de plantations devront être destinés essentiellement aux jeunes agriculteurs, aux producteurs de vins de qualité et aux exploitations qui ont été intégrées dans des programmes d'amélioration de la qualité et de la commercialisation et qui devront être intégrées au casier viticole réajusté; estime que chaque État membre, en coopération avec les régions, les organismes de filière et les groupements de producteurs, devra, avant le lancement de l'octroi de nouveaux droits de plantation, évaluer le programme d'arrachage et son évolution; estime que, avant d'octroyer de nouveaux droits de plantations, il faudra évaluer la situation relative aux plantations non légalisées ou illégales;
27. Considers that it is appropriate to proceed in a prudent and transparent manner as regards the progressive reattribution of new planting rights, in order to avoid unverifiable development in the EU's wine-growing potential having negative effects on the market: considers that the Member States must submit programmes which indicate the targeted level of plantation, an assessment of the developments in the granting of rights, the varieties concerned in each region and the time-table for application; stresses that the new plantation rights should primarily be given to young farmers, producers of quality wines and undertakings which have been integrated into the programmes for improvement of quality and marketing and which must be integrated into the readjusted wine register; considers that each Member State, in cooperation with the regions, sectoral organisations and producer groups must, with the launching of the grant of new planting rights, assess the grubbing-up programme and the way it has developed; considers that, before granting new planting rights, it will be necessary to evaluate the situation of plantings which have not been legalised or are illegal;

51. souligne que les difficultés auxquelles doit faire face le secteur vitivinicole, lesquelles découlent essentiellement des importations croissantes de vins en provenance de pays tiers et de l'augmentation des stocks de vin - qui dépassent la quantité produite en une année et qui ont peu de chance d'être écoulés -, exercent une pression à la baisse sur les prix et sur les revenus des producteurs et doivent être surmontées grâce à l'établissement d'une série de priorités élémentaires dont ne traite pas la communication précitée de la Commission, à savoir la promotion d'une consommation modérée et responsable, une réallocation des ressources budgétaires permettant d'atteindre de nouveaux consommateurs et de conquérir, voire de reconquérir, de nouveaux marchés, la promotion de la qualité et la stimulation de la recherche;
51. Points out that the difficulties facing the wine sector arising mainly from increasing wine imports from third countries and increasing numbers of wine stocks which exceed one year's production and have little prospect of being disposed of, exert a downward pressure on prices and producers" incomes and need to be tackled by the establishment of a set of basic priorities not taken into account in the abovementioned Commission communication, including, for example, encouraging moderate and responsible consumption, reallocating budgetary resources with a view to reaching new consumers and winning new markets or even recapturing markets, promoting quality and boosting research;

(20) Les règles applicables à l'étiquetage des produits vitivinicoles originaires de pays tiers et présents sur le marché communautaire doivent également être harmonisées dans la mesure du possible conformément à la méthode établie pour les produits vitivinicoles communautaires afin d'éviter toute confusion pour les consommateurs et toute concurrence déloyale pour les producteurs.
(20) The rules for labelling third-country wine sector products circulating on the Community market should also be harmonised as far as possible with the approach laid down for Community wine sector products in order to avoid misleading consumers and unfair competition for producers.

(45) compte tenu des caractéristiques du marché vitivinicole, la constitution de groupements de producteurs est de nature à contribuer à la réalisation des objectifs de l'organisation commune du marché; les États membres peuvent reconnaître de tels groupements; ceux-ci doivent se constituer sur une base volontaire et faire la preuve de leur utilité par l'étendue et l'efficacité des services qu'ils offrent à leurs membres;
(45) given the special features of the market in wine, the formation of producers' organisations is likely to contribute to the attainment of the objectives of the common organisation of the market; Member States may recognise such organisations; the latter must be formed on a voluntary basis and must prove their utility through the scope and efficiency of the services offered by producer organisations to their members;

(5) le principal problème de marché auquel certains acteurs du secteur vitivinicole communautaire doivent faire face actuellement est leur capacité limitée à s'adapter assez rapidement à l'évolution de la concurrence, tant sur le marché intérieur que sur le marché extérieur; l'actuelle organisation commune de marché n'a offert aucune solution pour les aires viticoles dont la production ne trouve manifestement pas de débouché rémunérateur; les aires dont les marchés sont en expansion n'ont, quant à elles, pas bénéficié d'une souplesse suffisante pour leur ouvrir des perspectives de développement;
(5) the most significant market problem currently facing certain parts of the Community wine sector is their limited ability to adapt sufficiently rapidly to competitive changes on both the internal and external market; the existing common organisation of the market has failed to offer solutions for wine-growing areas where production is clearly unable to find a remunerative market; there has been insufficient flexibility for those areas with expanding markets to allow scope for development;

(73) la réalisation d'un marché unique serait compromise par l'octroi de certaines aides; dès lors, il convient que les dispositions du traité permettant d'apprécier les aides accordées par les États membres et de prohiber celles qui sont incompatibles avec le marché commun soient rendues applicables dans le secteur vitivinicole; les dispositions relatives aux primes d'abandon définitif de superficies viticoles ne doivent pas faire obstacle à l'octroi d'aides prévues par les réglementations nationales aux mêmes fins;
(73) the establishment of a single market would be jeopardised by the granting of certain aids; the provisions of the Treaty which allow the assessment of aids granted by Member States and the prohibition of those which are incompatible with the common market should therefore apply in the common market organisation for wine; the provisions on premiums for the permanent abandonment of wine-growing should not of themselves preclude the granting of national aid for the same ends;
