By analogy with the case-law on public procurement and concessions which provides that the in-house operator’s activities should not be ‘market-oriented’ (22), the condition of Article 5(2)(b) that ‘the internal operator [.] perform their public passenger transport activity within the territory of the competent local authority, [.] and do not take part in competitive tenders concerning the provision of public passenger transport services organised outside the territory of the competent local authority’ should be interpreted as follows: the internal operator or the entity influenced by the internal operator must not operate public passenger transport services, including as a subcontractor, or participate in tender procedures outside the competent authority’s territory within the Union or, due to a possible indirect effect on the internal market, elsewhere in the world.

However, the provision to that effect made by this Directive cannot be relied upon in order to justify authorisation schemes which are prohibited by other Community instruments such as Directive 1999/93/EC of the European Parliament and the Council of 13 December 1999 on a Community framework for electronic signatures (17), or Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the internal market (Directive on electronic commerce) (18).

Hence the importance of co-ordination and of ensuring that public procurement and concession rules work in favour of large scale projects and encourage public-private partnerships, of getting the right tax and regulatory treatment of the cross-border and venture capital operations which may promote these projects and of ensuring a level playing field in terms of simplified rules on state aids for SMEs investing in RD. Furthermore, it is essential to press on with efforts to integrate and remove barriers within the internal market in key network sectors from railways and port services to electronic communications and financial markets.
