(9) Council Regulation (EC) No 708/2007 of 11 June 2007 concerning use of alien and locally absent species in aquaculture , Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products and Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC provide for rules concerning the authorisation for the use of certain alien species for particular purposes.

By way of derogation from Articles 17 and 18, a competent authority may permit, for a period not exceeding 270 days, the making available on the market or use of a biocidal product which does not fulfil the conditions for authorisation laid down in this Regulation, for a limited and controlled use, if such a measure is necessary because of a danger to public health or the environment which cannot be contained by other means.

By way of derogation from Articles 17 and 18, a competent authority may permit, for a period not exceeding four months, the making available on the market or use of a biocidal product which does not fulfil the conditions for authorisation laid down in this Regulation, for a limited and controlled use, if such a measure is necessary because of a danger to public health or the environment which cannot be contained by other means, and if all of the following conditions are met:

A market-based approach should be the main guiding principle with other non-market measures, such as the release of strategic stocks or the switching of fuels being used when the market fails.

(23) Pour faire en sorte que seuls les produits biocides conformes aux dispositions du présent règlement puissent être mis sur le marché, il convient que les produits biocides fassent l'objet d'une autorisation de mise sur le marché ou d'utilisation sur tout ou partie du territoire d'un État membre, délivrée par les autorités compétentes, ou d'une autorisation de mise sur le marché ou d'utilisation dans l'Union, délivrée par la Commission.
(23) In order to ensure that only biocidal products that comply with the relevant provisions of this Regulation are placed on the market, biocidal products should be subject to authorisation either by competent authorities for placing on the market or use in the territory of a Member State, or a part of it, or by the Commission for placing on the market or use in the Union.

Nonobstant l'article 82, lorsque l'autorité compétente, ou la Commission dans le cas d'un produit biocide autorisé au niveau de l'Union, annule ou modifie une autorisation ou décide de ne pas la renouveler, elle accorde un délai de grâce pour l'élimination, le stockage, la mise sur le marché et l'utilisation des stocks existants, à moins que le maintien sur le marché ou la poursuite de l'utilisation ne représentent un risque inacceptable pour la santé humaine ou pour l'environnement.
Notwithstanding Article 82, where the competent authority or, in the case of a biocidal product authorised at Union level, the Commission, cancels or amends an authorisation or decides not to renew it, it shall grant a period of grace for the disposal, storage, placing on the market and use of existing stocks except in cases where continued placing on the market or use of the product would constitute an unacceptable risk to human health or the environment.

Étant donné que l’objectif du présent règlement, à savoir harmoniser les conditions de mise sur le marché et d’utilisation des aliments pour animaux, de manière à garantir un niveau élevé de sécurité des aliments pour animaux et donc un niveau élevé de protection de la santé publique ainsi qu’à fournir une information adéquate aux utilisateurs et aux consommateurs et à renforcer le bon fonctionnement du marché intérieur, ne peut pas être réalisé de manière suffisante par les États membres et peut donc être mieux réalisé au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l’article 5 du traité.
Since the objective of this Regulation, namely harmonisation of the conditions for the placing on the market and the use of feed, in order to ensure a high level of feed safety and thus a high level of protection of public health as well as to provide adequate information for users and consumers and to strengthen the effective functioning of the internal market, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

L’objectif du présent règlement, conformément aux principes généraux établis dans le règlement (CE) no 178/2002, consiste à harmoniser les conditions de mise sur le marché et d’utilisation des aliments pour animaux, de manière à garantir un niveau élevé de sécurité des aliments pour animaux et donc un niveau élevé de protection de la santé publique ainsi qu’à fournir une information adéquate aux utilisateurs et aux consommateurs et à renforcer le bon fonctionnement du marché intérieur.
The objective of this Regulation, in accordance with the general principles laid down in Regulation (EC) No 178/2002, is to harmonise the conditions for the placing on the market and the use of feed, in order to ensure a high level of feed safety and thus a high level of protection of public health, as well as to provide adequate information for users and consumers and to strengthen the effective functioning of the internal market.

La mise sur le marché et l'utilisation de la plupart des polluants organiques persistants figurant sur les listes du protocole ou de la convention ont déjà été progressivement éliminées dans la Communauté par l'intermédiaire des interdictions établies par la directive 79/117/CEE du Conseil du 21 décembre 1978 concernant l'interdiction de mise sur le marché et d'utilisation des produits phytopharmaceutiques contenant certaines substances actives (5), et par la directive 76/769/CEE du Conseil du 27 juillet 1976 concernant le rapprochement des dispositions législatives, réglementaires et administratives des États membres relatives à la limitation de la mise sur le marché et de l'emploi de certaines substances et préparations dangereuses (6).
In the Community, the placing on the market and use of most of the persistent organic pollutants listed in the Protocol or the Convention has already been phased out as a result of the prohibitions laid down in Council Directive 79/117/EEC of 21 December 1978 prohibiting the placing on the market and use of plant protection products containing certain active substances (5) and Council Directive 76/769/EEC of 27 July 1976 on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (6).
