1. This Regulation introduces a common approach to ensuring that users of public mobile communications networks, when travelling within the Union, do not pay excessive prices for Union-wide roaming services in comparison with competitive national prices, when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, fostering competition and transparency in the market and offering both incentives for innovation and consumer choice.

1. Le présent règlement instaure une approche commune pour faire en sorte que les usagers des réseaux publics de communications mobiles qui voyagent à l'intérieur de l'Union ne paient pas un prix excessif pour les services d'itinérance dans l'Union, par comparaison avec les prix nationaux concurrentiels, lorsqu'ils passent et reçoivent des appels, envoient et reçoivent des SMS et lorsqu'ils utilisent des services de communication de données par commutation de paquets, et contribuer ainsi au fonctionnement harmonieux du marché intérieur tout en garantissant un degré élevé de protection des consommateurs, en favorisant la concurrence et la transparence sur le marché et en offrant à la fois des incitations à l'innovation et un choix aux consommateurs.

This Regulation introduces a common approach to ensuring that users of public mobile communications networks, when travelling within the Union, do not pay excessive prices for Union-wide roaming services in comparison with competitive national prices, when making calls and receiving calls, when sending and receiving SMS messages and when using packet switched data communication services, thereby contributing to the smooth functioning of the internal market while achieving a high level of consumer protection, fostering competition and transparency in the market and offering both incentives for innovation and consumer choice.

Throughout the Regulations listed in the Annex, any reference to ‘European Community’, ‘Community’, ‘European Communities’ or ‘Communities’ shall be understood as a reference to the European Union or Union; any reference to the words ‘common market’ shall be understood as a reference to ‘internal market’; any reference to the words ‘Committee provided for in Article 113’, ‘Committee provided for in Article 133’, ‘Committee referred to in Article 113’ and ‘Committee referred to in Article 133’ shall be understood as a reference to ‘Committee provided for in Article 207’; any reference to the words ‘Article 113 of the Treaty’ or ‘Article 133 of the Treaty’ shall be understood as a reference to ‘Article 207 of the Treaty’.

1. Aid schemes fulfilling all the conditions of Chapter I of this Regulation, as well as the relevant provisions of Chapter II of this Regulation, shall be compatible with the common market within the meaning of Article 87(3) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty provided that any individual aid awarded under such scheme fulfils all the conditions of this Regulation, and the scheme contains an express reference to this Regulation, by citing its title and publication reference in the Official Journal of the European Union

This article of the EC Treaty stipulates that as part of the single market 'any Member State may take such measures as it considers necessary for the protection of the essential interests of its security which are connected with the production of or trade in arms, munitions and war material'; however it goes on to state that 'such measures shall not adversely affect the conditions of competition in the common market regarding products which are not intended for specifically military purposes'.

Il convient donc, par souci de sécurité juridique, de préciser que le présent règlement prévoit un contrôle effectif de toutes ces concentrations en établissant que toute concentration qui entraverait de manière significative une concurrence effective, dans le marché commun ou une partie substantielle de celui-ci, devrait être déclarée incompatible avec le marché commun.
Therefore, in the interests of legal certainty, it should be made clear that this Regulation permits effective control of all such concentrations by providing that any concentration which would significantly impede effective competition, in the common market or in a substantial part of it, should be declared incompatible with the common market.

With a view to preserving the guidance that may be drawn from past judgments of the European courts and Commission decisions pursuant to Regulation (EEC) No 4064/89, while at the same time maintaining consistency with the standards of competitive harm which have been applied by the Commission and the Community courts regarding the compatibility of a concentration with the common market, this Regulation should accordingly establish the principle that a concentration with a Community dimension which would significantly impede effective competition, in the common market or in a substantial part thereof, in particular as a result of the creation or strengthening of a dominant position, is to be declared incompatible with the common market.

À cet égard, l'OCM de 1993 répond à quatre objectifs essentiels : assurer la libre circulation des bananes dans le marché commun tout en maintenant des prix raisonnables pour le consommateur, respecter les engagements de l'Union envers les pays ACP, maintenir la préférence communautaire pour les producteurs de l'Union, telle que la Martinique, la Guadeloupe, les îles Canaries, Madère et la Crète, et enfin, respecter les obligations du GATT.
In that connection the 1993 COM complied with four essential objectives: ensuring the free movement of bananas in the single market while maintaining reasonable prices for consumers, respecting the Union’s commitment to the ACP countries, maintaining Community preference for Union producers like Martinique, Guadeloupe, the Canaries, Madeira and Crete and, finally, respecting GATT obligations.
