In Coditel II (para. 14), the Court clarified that "just as it is conceivable that certain aspects of the manner in which the right is exercised may prove to be incompatible with Articles 59 and 60 it is equally conceivable that some aspects may prove to be incompatible with Article 85 where they serve to give effect to an agreement, decision or concerted practice which may have as its object or effect the prevention, restriction or distortion of competition within the common market".

In such cases aids to provide compensation for the losses incurred, and aids to prevent future losses may only be permitted by the Commission on the basis of Article 87(3)(c) of the Treaty, which provides that aids to facilitate the development of certain activities may be considered compatible with the common market provided that it does not affect trading conditions to an extent contrary to the common interest.

2. Toute aide accordée avant le 31 décembre 2008 qui ne remplit pas les conditions prévues par le présent règlement, mais qui remplit celles prévues par le règlement (CE) no 70/2001, le règlement (CE) no 68/2001, le règlement (CE) no 2204/2002 ou le règlement (CE) no 1628/2006 est compatible avec le marché commun et est exemptée de l’obligation de notification prévue à l'article 88, paragraphe 3, du traité.
2. Any aid granted before 31 December 2008, which does not fulfil the conditions laid down in this Regulation but fulfils the conditions laid down in Regulation (EC) No 68/2001, Regulation (EC) No 70/2001, Regulation (EC) No 2204/2002 or Regulation (EC) No 1628/2006 shall be compatible with the common market and exempt from the notification requirement of Article 88(3) of the Treaty.
