(6) Il convient, au regard des objectifs communautaires, des articles 43 et 49 du traité et du droit communautaire dérivé, de supprimer ces obstacles par une coordination de certaines législations nationales et par une clarification au niveau communautaire de certains concepts juridiques, dans la mesure nécessaire au bon fonctionnement du marché intérieur. La présente directive, en ne traitant que certaines questions spécifiques qui soulèvent des problèmes pour le marché intérieur, est pleinement cohérente avec la nécessité de respecter le principe de subsidiarité tel qu'énoncé à l'article 5 du traité.
(6) In the light of Community objectives, of Articles 43 and 49 of the Treaty and of secondary Community law, these obstacles should be eliminated by coordinating certain national laws and by clarifying certain legal concepts at Community level to the extent necessary for the proper functioning of the internal market; by dealing only with certain specific matters which give rise to problems for the internal market, this Directive is fully consistent with the need to respect the principle of subsidiarity as set out in Article 5 of the Treaty.

Whereas the procedure established in Article 3 of Commission Regulation (EEC) No 207/93 (4) has to be revised in the light of the experience gained and of developments concerning the availability on the Community market of certain organically produced ingredients of agricultural origin;

Whereas the said Annex VI will have to be reviewed regularly in the light of experience gained and of developments with in the availability on the Community market of certain organically produced ingredients of agricultural origin;

considérant que, en convertissant en droits de douane l'ensemble des mesures qui restreignent l'importation de produits agricoles (tarification) et en interdisant l'application pour l'avenir de telles mesures, l'accord requiert la suppression des prélèvements variables à l'importation ainsi que des autres mesures et charges à l'importation qui à présent sont prévues dans les organisations communes des marchés; que les taux des droits de douane applicables selon l'accord pour les produits agricoles seront fixés dans le tarif douanier commun; que, toutefois, dans certains secteurs comme ceux des céréales, du riz, du vin et des fruits et légumes, l'introduction de mécanismes complémentaires ou autres que la perception des droits de douane stables nécessite l'adoption de règles dérogatoires dans les règlements de base; que, en outre, les mesures de protection du marché communautaire contre l'importation de raisins secs et de cerises transformées peuvent être maintenues, en vertu de l'accord sur les sauvegardes, pour une période de cinq ans; que, par ailleurs, afin d'éviter des problèmes d'approvisionnement du marché communautaire, il est indiqué d'admettre la suspension de l'application des droits de douane pour certains produits dans le secteur du sucre;
Whereas, by converting all the measures restricting imports of agricultural products into customs duties (tarification) and by prohibiting the application of such measures in the future, the Agreement requires the abolition of variable import levies and of the other measures and import charges currently provided for under the market organizations; whereas the rates of customs duty applicable to agricultural products in accordance with the Agreement are to be fixed in the Common Customs Tariff; whereas, however, for certain product groups such as cereals, rice, wine and fruit and vegetables, the introduction of supplementary or other trade mechanisms that do not involve the collection of fixed customs duties calls for the adoption of rules providing for derogations in the basis regulations; whereas, in addition, the measures to protect the Community market against imports of dried grapes and processed cherries can, under the Agreement on Safeguards, be maintained for a period of five years; whereas, moreover, in order to avert problems of supply to the Community market, the suspension of customs duties on certain sugar products should be permitted;
